文明轉(zhuǎn)型與中國特色法治發(fā)展之路

【摘要】：新中國建立之前,中國一直沒有完成由農(nóng)耕文明政治統(tǒng)治向商工文明的法律治理的轉(zhuǎn)型。在中國共產(chǎn)黨領(lǐng)導(dǎo)下,經(jīng)過艱難探索,伴隨著改革開放,中國展開了法治建設(shè)的歷程。因各種歷史性因素的影響,當(dāng)代中國法治之路有自己的特點(diǎn),它們包括:由中國共產(chǎn)黨領(lǐng)導(dǎo)和推進(jìn);以人民代表大會(huì)制度為基本制度依托;在賦予政府巨大責(zé)任和權(quán)力的同時(shí)對(duì)其加以必要約束限制;在對(duì)中國傳統(tǒng)法文化揚(yáng)棄的過程中不斷走向成熟。
