傳統(tǒng)“德治”的意蘊——兼論德治與法治的關(guān)系

【摘要】：中國傳統(tǒng)"德治"形成于西漢,其內(nèi)涵是德性、德政和道德教化。"德治"的基本意蘊:"德治"是以漢承秦制為背景的;"德治"是汲取秦朝獨任刑罰教訓(xùn)的舉措;"德治"是力主"德主刑輔"即發(fā)揮道德教化引導(dǎo)民眾的主導(dǎo)作用;"德治"是倡導(dǎo)"前德后刑";"德治"是以法治為保障,以法治為標準和目標的。
