【摘要】：《唐律疏議》中的"疏議"主要可以分為前言"疏議"與律條"疏議"。前言"疏議"在每篇的篇首,律條"疏議"則緊隨在律條之后。前言"疏議"的篇幅很小,其字數(shù)僅為《唐律疏議》總字數(shù)的3%左右�！短坡墒枳h》的前言"疏議"又可分為《名例》的前言"疏議"與其他篇前言"疏議"。《名例》前言"疏議"的主要內(nèi)容包括:明示《唐律疏議》的指導(dǎo)思想、揭示制定刑法的重要意義、梳理律典的制訂與發(fā)展過程、解釋《名例》列為首篇的原因等。其他11篇前言"疏議"的主要內(nèi)容則是:敘述每篇的由來、表達每篇所含主要內(nèi)容、表明篇目排列的邏輯聯(lián)系等。與《唐律疏議》前言"疏議"相關(guān)聯(lián),還有一些問題值得關(guān)注,主要是:《唐律疏議》中的前言"疏議"與律條"疏議"的差異、前言"疏議"的功能與地位、對當(dāng)今法治建設(shè)的啟示等。
[Abstract]:The thinning discussion in Tang Law can be divided into the preface and the rule. The foreword is at the beginning of each article, and the rule is followed by the rule. The preface of "sparsely discussed" is very small, The number of words is only about 3% of the total number of words. The foreword "sparing discussion" of < Tang Law sparsely comment > can be divided into the preface of "famous example" and the other preface "sparse discussion". The main content of < name > preface is "sparse discussion". Including: express the guiding ideology of Tang Law, It reveals the significance of making criminal law, combs the process of making and developing the law code, and explains the reasons why "famous example" is listed as the first part. The main contents of the other 11 prefaces are: to describe the origin of each article, to express the main contents contained in each article, and to show the logical relation of the arrangement of the articles and so on. There are still some problems worth paying attention to in connection with the foreword of Tang Law, mainly the difference between the foreword and the rule, the function and status of the foreword. The enlightenment to the construction of the rule of law today.
