伯爾曼法律傳統(tǒng)形成觀及對中國法制建設(shè)的啟示

【摘要】：伯爾曼嘔心瀝血寫成了“法律與革命”,在他的思想中,他對西方法律傳統(tǒng)的產(chǎn)生、發(fā)展的歷史過程進(jìn)行了全面剖析,創(chuàng)造性的找到了西方法律傳統(tǒng)與六次革命(教皇革命、德國革命、英國革命、法國革命、美國革命和俄國革命)同呼吸、共命運(yùn)的聯(lián)系。教皇革命為西方的憲政奠定了堅(jiān)實(shí)基礎(chǔ),也使“王權(quán)與教權(quán)”分立,德國革命頒布了里程碑式的《卡羅林納法典》,它確立的刑法原則至今還未現(xiàn)代西方廣泛采用。英國革命是普通法法院的勝利,普通法法院比其他法院更能保護(hù)民眾的利益,且確立了大量的民法和刑法原則,美國革命誕生了獨(dú)立宣言,確立了一系列如著名的司法審查制度的獨(dú)創(chuàng)的憲法原則。法國革命頒布的《人權(quán)宣言》、《法國民法典》更是對整個西方世界都起到了廣泛的影響。美國革命頒布了《獨(dú)立宣言》,并確立了一系列獨(dú)創(chuàng)的憲法原則,如著名的司法審查制度俄國革命徹底推翻了封建沙皇的統(tǒng)治,并頒布了社會主義法律。在這些重大革命的過程中宗教起到了舉足輕重的作用,因?yàn)樽诮淌俏鞣轿拿鞯幕A(chǔ),法律的淵源,革命的引線。當(dāng)今社會西方法律信仰的喪失也正是由于宗教衰落所致。伯爾曼作為一個虔誠的基督徒,深感宗教衰落的危機(jī),因此希望他的“法律與革命”思想能夠重塑宗教和信仰的重要地位。雖然伯爾曼思想中宗教的因素被夸大,但是仍然有很多值得當(dāng)代中國借鑒的地方。
[Abstract]:Berman wrote "Law and Revolution" with painstaking effort. In his thought, he made a comprehensive analysis of the historical process of the emergence and development of western legal tradition, and creatively found the western legal tradition and six revolutions (papal revolution, papal revolution). The German Revolution, the British Revolution, the French Revolution, the American Revolution and the Russian Revolution) the relationship between the German Revolution, the British Revolution, the French Revolution, the American Revolution and the Russian Revolution. The papal revolution laid a solid foundation for western constitutionalism and separated Wang Quan from religious power. The German Revolution promulgated the landmark "Carolina Code", which has not been widely adopted in modern western countries. The British Revolution was the triumph of the common law courts, which protected the interests of the people more than other courts and established a large number of principles of civil and criminal law. The American Revolution gave birth to the Declaration of Independence. A series of original constitutional principles, such as the famous judicial review system, have been established. The Declaration of Human Rights promulgated by the French Revolution and the French Civil Code have exerted a wide influence on the whole western world. The American Revolution promulgated the Declaration of Independence and established a series of original constitutional principles such as the famous judicial review system the Russian revolution completely overthrew the rule of the feudal czar and promulgated socialist laws. Religion plays an important role in these great revolutions, because religion is the foundation of western civilization, the origin of law and the lead of revolution. The loss of legal belief in the West is also due to the decline of religion. As a devout Christian, Berman felt the crisis of religious decline and hoped that his thought of "law and revolution" could restore the importance of religion and belief. Although the religious factors in Berman's thought are exaggerated, there are still many references for contemporary China.
