論我國法律配套規(guī)定的消減

【摘要】：長久以來,我國法律的有效實施大量依賴法律的配套規(guī)定。這是由我國的諸多歷史背景決定的。但是,理論和實踐中,對配套規(guī)定基本范疇的界定并沒有達(dá)成共識。過度依賴配套規(guī)定也為法律自身和社會治理帶來了不少消極影響。如今,造成配套規(guī)定產(chǎn)生和存在的因素不斷弱化:立法經(jīng)驗的積累,對改革的認(rèn)識趨于清晰,改革越來越穩(wěn)定。立法機(jī)關(guān)制定的法律應(yīng)當(dāng)轉(zhuǎn)向具體、可操作、逐漸精細(xì)化的道路,逐步減少法律的配套規(guī)定。
[Abstract]:For a long time, the effective implementation of the law in our country relies heavily on the supporting provisions of the law. This is decided by the many historical background of our country. However, in theory and practice, there is no consensus on the definition of basic categories of supporting provisions. Excessive dependence on supporting provisions has also brought a lot of negative effects to the law itself and social governance. Nowadays, the factors that lead to the emergence and existence of supporting regulations are weakening: the accumulation of legislative experience, the clear understanding of the reform, and the stability of the reform. Legislatures should turn to specific, operable and gradually refined ways, and gradually reduce the supporting provisions of the law.
