論法律論證合理性的標準

【摘要】：認識論和方法論的轉(zhuǎn)向催生出了法律論證理論的研究,并在學(xué)者們不斷努力和創(chuàng)新下取得了許多顯著的研究成果,但對法律論證合理性這個最基本問題的思考和追問卻鮮有人問津,對法律論證合理性的標準更是莫衷一是,模糊難辨。伴隨司法裁判中出現(xiàn)的許多令社會公眾普遍爭議、對裁判結(jié)果難以接受的案件,研究討論法律論證的合理性問題進入了筆者的視野。本文指的法律論證僅指狹義的法律論證,也就是司法裁判。筆者認為法律論證的合理性首先必須具備形式合理性和實質(zhì)合理性,不僅在程序上有體現(xiàn),更要在論證結(jié)果上具有合理性,在法律和社會對合理性的內(nèi)在和外在要求上達到一致,在內(nèi)在的合理性與外在的合理性之間趨向平衡統(tǒng)一。法律論證合理性的標準是由內(nèi)而外和由外而內(nèi)相互融合的整體,體現(xiàn)在內(nèi)在標準和外在標準的結(jié)合上。其內(nèi)在標準主要由法律論證的要素決定,外在標準則體現(xiàn)在公眾表達的民意之上。內(nèi)在標準使論證的合理性具備法律和事實基礎(chǔ),理性的民意這個合理性的外在標準使合理性具備社會基礎(chǔ)。本文將司法裁判作為中心視角,以之研究司法裁判中的法律論證的合理性問題,這種合理性在各種復(fù)雜因素的影響下只能是相對的合理性,絕對的合理性是不存在的。 全文共通過五個部分來對主題進行闡述,包括“法律論證合理性的標準概述”、“法律論證合理性的內(nèi)在標準”、“法律論證合理性的外在標準”、“法律論證合理性內(nèi)外標準的關(guān)系”、“結(jié)論”等內(nèi)容。引言主要談及法律論證的合理性及其認定標準的重要性和價值。第一章主要介紹法律論證的合理性及其標準問題。第二章分析探討法律論證的要素及其合理性的四個內(nèi)在標準。第三章主要論及合理性論證對民意理性的吸納,理性的民意是法律論證合理性的外在標準。第四章分析法律論證內(nèi)外標準之間的關(guān)系。結(jié)論主要是對法律論證合理性的判定標準是內(nèi)外標準由內(nèi)而外和由外而內(nèi)的滲透融合,來實現(xiàn)司法個案中法律和事實基礎(chǔ)與社會基礎(chǔ)的對接。法律論證中公眾民意參與司法裁判可以形成良性的司法互動,營造出一種和諧的司法氛圍,使涵蓋社會普遍價值觀的社情民意與法律行為實現(xiàn)真正意義上的水乳交融。 以上便是本文所要論述的主要問題和觀點,也是本文的主要內(nèi)容。通過考察幾種法律論證理論中的合理性,思考如何對合理性進行判定,筆者提出了自己的觀點：法律論證合理性的標準不僅體現(xiàn)在內(nèi)在的四大要素合理性基礎(chǔ)之上,更重要的是離不開公眾民意的維度,只有同時遵循合理性論證的內(nèi)外標準才有希望走出司法裁判可接受性追求的困境。
[Abstract]:The turn of epistemology and methodology gave birth to the study of the theory of legal argumentation, and made many remarkable achievements under the constant efforts and innovations of scholars. But the most basic question of rationality of legal argumentation is that few people are interested in it, and the standard of rationality of legal argumentation is even more ambiguous and difficult to discern. With the emergence of a lot of public disputes in the judicial decision, the author studies and discusses the rationality of legal argumentation in cases where the result of adjudication is difficult to accept. The legal argumentation in this paper only refers to the narrow legal argument, that is, the judicial decision. The author thinks that the rationality of legal argumentation must have formal rationality and substantial rationality, not only in procedure, but also in the result of argumentation. It is consistent with the internal and external demands of law and society on rationality, and tends to balance and unify between internal rationality and external rationality. The standard of rationality of legal argumentation is a whole from inside to outside and from outside to inside, which is embodied in the combination of internal standard and external standard. The internal standard is mainly determined by the elements of legal argumentation, while the external standard is reflected in the public opinion. The internal standard makes the rationality of argumentation have the legal and factual basis, and the rational public opinion, the external standard of rationality, makes the rationality have the social basis. This paper takes the judicial decision as the central angle of view to study the rationality of the legal argument in the judicial decision. This rationality can only be relative rationality under the influence of various complicated factors, and the absolute rationality does not exist. The thesis expounds the theme through five parts, including "the Standard Summary of legal argumentation rationality", "the Internal Standard of legal argumentation rationality", "the external Standard of legal argumentation rationality". The relationship between internal and external standards of rationality in legal argumentation and the conclusion. The introduction mainly talks about the rationality of legal argumentation and the importance and value of its standard. The first chapter mainly introduces the rationality and standard of legal argumentation. The second chapter analyzes the elements of legal argumentation and four internal standards of rationality. The third chapter mainly discusses the rational absorption of public opinion rationality, rational public opinion is the external standard of rationality of legal argumentation. Chapter four analyzes the relationship between internal and external standards of legal argumentation. The conclusion is that the judgment standard of rationality of legal argumentation is the penetration of internal and external standards from inside to outside and from outside to inside to realize the docking between the legal and factual basis and the social basis in judicial cases. In legal argumentation, public opinion participation in judicial adjudication can form a benign judicial interaction, create a harmonious judicial atmosphere, and make the social feelings and public opinion and legal acts, which cover the social values, become truly harmonious. The above are the main problems and viewpoints discussed in this paper, and are also the main contents of this paper. By examining the rationality of several kinds of legal argumentation theories and thinking about how to judge rationality, the author puts forward his own viewpoint: the standard of rationality of legal argumentation is not only embodied in the inherent four elements of rationality, More importantly, it is inseparable from the dimensions of public opinion. Only by adhering to the internal and external standards of rationality argument can we hope to get out of the dilemma of the pursuit of acceptability of the judicial decision.
