【摘要】：鄧小平自中共十一屆三中全會(huì)以后,強(qiáng)調(diào)要把發(fā)揚(yáng)民主健全法制作為黨和國(guó)家堅(jiān)定不移的方針,對(duì)社會(huì)主義民主法制建設(shè)的各個(gè)方面和領(lǐng)域,進(jìn)行了較為全面的論述,形成了內(nèi)容豐富系統(tǒng)的鄧小平法制思想,成為鄧小平理論的重要內(nèi)容。自改革開放以來,中國(guó)特色社會(huì)主義法治發(fā)展道路的探索已經(jīng)歷了五個(gè)具有里程碑意義的發(fā)展階段。這五個(gè)里程碑分別是1978年中共十一屆三中全會(huì)的召開;1980年鄧小平在中央政治局?jǐn)U大會(huì)議上的講話;1992年鄧小平視察南方的談話;1997年中共十五大依法治國(guó)方略的提出;2012年中共十八大以來開啟的依法治國(guó)新征程,尤其是十八屆四中全會(huì)關(guān)于全面推進(jìn)依法治國(guó)的頂層設(shè)計(jì)。這五個(gè)里程碑和鄧小平及其法制思想從理論邏輯上說均有密切的關(guān)系。全面推進(jìn)依法治國(guó),建設(shè)社會(huì)主義法治國(guó)家,以鄧小平法制思想為指導(dǎo),應(yīng)體現(xiàn)在以下方面,堅(jiān)持中國(guó)法治道路的民族特性,堅(jiān)持理論上的超越與創(chuàng)新,堅(jiān)持學(xué)習(xí)、借鑒與立足中國(guó)國(guó)情相結(jié)合,堅(jiān)持立足中國(guó)法治建設(shè)的現(xiàn)實(shí)需要和實(shí)踐基礎(chǔ)。
[Abstract]:Since the third Plenary session of the Eleventh Central Committee of the Communist Party of China (CPC), Deng Xiaoping has stressed the importance of promoting democracy and improving the legal system as a firm policy of the Party and the state, and has made a relatively comprehensive exposition on all aspects and fields of the construction of socialist democracy and the legal system. The idea of Deng Xiaoping legal system, which is rich in content, has become an important content of Deng Xiaoping theory. Since the reform and opening up, the development of socialism with Chinese characteristics has undergone five milestone stages. The five milestones were the opening of the third Plenary session of the 11th CPC Central Committee in 1978; the speech of the Deng Xiaoping at the enlarged meeting of the political Bureau of the CPC Central Committee in 1980; the talk of Deng Xiaoping's visit to the South in 1992; and the proposal of the strategy of governing the country according to law at the 15th CPC Congress in 1997. The new journey of ruling the country according to law, which has begun since the 18th CPC National Congress in 2012, In particular, the fourth Plenary session of the 18 th Central Committee on the overall promotion of the rule of law at the top of the design. These five milestones are closely related to Deng Xiaoping and his legal thought theoretically and logically. To advance the rule of law in an all-round way and to build a socialist country ruled by law, and guided by the legal ideology of Deng Xiaoping, we should adhere to the national characteristics of the road of rule of law in China, persist in transcending and innovating in theory, and persist in learning. Combining reference with China's national conditions, we insist on the practical needs and practical basis of China's rule of law construction.
