瞿同祖法律思想研究

【摘要】:瞿同祖作為近代中國(guó)社會(huì)轉(zhuǎn)型期的知識(shí)分子,對(duì)中國(guó)法律與中國(guó)社會(huì)的研究在中國(guó)學(xué)術(shù)史上具有承上啟下的重大作用,他認(rèn)為在研究法律的時(shí)候,應(yīng)當(dāng)密切注意法律與社會(huì)之間的關(guān)系,而不能像分析主義法學(xué)將法律與政治、經(jīng)濟(jì)、文化等社會(huì)現(xiàn)象割裂開來(lái),法律是社會(huì)的產(chǎn)物,只有充分了解一部法律產(chǎn)生的社會(huì)背景,才能了解這些法律的意義和作用。他采用功能主義分析方法對(duì)兩千多年的中國(guó)傳統(tǒng)社會(huì)中的法律精神進(jìn)行分析,這種方法在新中國(guó)成立前具有很明顯的時(shí)代性,瞿同祖采用西方社會(huì)學(xué)的方法來(lái)研究中國(guó)傳統(tǒng)社會(huì)中的法律現(xiàn)象及其精神,對(duì)中國(guó)法學(xué)研究的貢獻(xiàn)極大。但是我國(guó)學(xué)術(shù)界并沒(méi)有對(duì)他的學(xué)術(shù)思想進(jìn)行更系統(tǒng)的總結(jié),也沒(méi)有進(jìn)行更深入的研究。為此,本文打算在深入分析瞿同祖所處的時(shí)代背景和理論背景的基礎(chǔ)上,結(jié)合瞿同祖著作,對(duì)瞿同祖的思想進(jìn)行一次系統(tǒng)的總結(jié)、分析與梳理,希望能彌補(bǔ)我國(guó)法社會(huì)學(xué)研究上的相關(guān)空白,為學(xué)術(shù)傳承盡一份心力,為社會(huì)主義法律體系的建設(shè)提供一些參考性的材料。 本文在結(jié)構(gòu)上分為三個(gè)部分。 第一部分介紹瞿同祖法律思想的理論淵源和時(shí)代背景,主要解決瞿同祖研究中國(guó)法律與中國(guó)社會(huì)的時(shí)代大背景,分析了在社會(huì)格局發(fā)生變化的情況下,瞿同祖思想的時(shí)代性。當(dāng)時(shí)的歷史法學(xué)、法社會(huì)學(xué)等思想影響了瞿同祖法社會(huì)學(xué)思想的形成。 第二部分討論瞿同祖法律思想的主要內(nèi)容,通過(guò)分析瞿同祖的著作以及其它相關(guān)文章,研究瞿同祖法律思想的基本內(nèi)容。認(rèn)為瞿同祖的法學(xué)思想主要是法社會(huì)學(xué)思想,主要包括兩大部分:一是對(duì)中國(guó)傳統(tǒng)法律與社會(huì)之間關(guān)系的研究,通過(guò)對(duì)家族法與國(guó)家法的性質(zhì)及相互關(guān)系的研究,認(rèn)為中國(guó)傳統(tǒng)社會(huì)的性質(zhì)是身份社會(huì),在這種身份社會(huì)下,中國(guó)傳統(tǒng)法律的特點(diǎn)是倫理法律;二是在得出這樣一個(gè)結(jié)論的過(guò)程中,瞿同祖主要采用了功能主義的分析方法和實(shí)證的研究方法,本文對(duì)這兩種研究方法進(jìn)行分析,認(rèn)為在研究歷時(shí)兩千多年的中國(guó)傳統(tǒng)社會(huì)的法律精神時(shí),采用功能主義的分析方法具有一定的優(yōu)越性,但是也有不可忽視的缺點(diǎn)。在實(shí)證的分析方法中,瞿同祖廣泛采用了法學(xué)、社會(huì)學(xué)等學(xué)科的材料來(lái)研究分析中國(guó)傳統(tǒng)社會(huì)中的法律,從而得出中國(guó)古代法律的特征和精神是什么,這是后輩學(xué)人必須要學(xué)習(xí)之處。這一部分分兩章來(lái)陳述,是本文的重點(diǎn)。 第三部分分析瞿同祖法律思想在當(dāng)代中國(guó)法律體系完善和法學(xué)研究中的作用,主要考察在社會(huì)主義法律體系的完善過(guò)程中如何對(duì)待民間法的作用,在社會(huì)主義法學(xué)體系的建立過(guò)程中如何重視方法論的作用。
[Abstract]:As an intellectual in the transition period of modern Chinese society, qu Tongzu played an important role in the study of Chinese law and Chinese society in the academic history of China. We should pay close attention to the relationship between law and society, instead of separating law from political, economic, cultural and other social phenomena, like analytical jurisprudence. Law is the product of society, and only a full understanding of the social background of a law can be obtained. In order to understand the significance and role of these laws. He used the functionalist analysis method to analyze the legal spirit in the traditional Chinese society for more than two thousand years. This method had an obvious contemporary character before the founding of New China. Qu Tongzu made great contributions to the study of the legal phenomena and spirit in Chinese traditional society by means of western sociology. But the academic circles of our country have not carried on the more systematic summary to his academic thought, also has not carried on the deeper research. Therefore, on the basis of deep analysis of the background of qu Tongzu's times and theories, and combined with qu Tongzu's works, this paper intends to make a systematic summary, analysis and combing of qu Tongzu's thoughts. It is hoped that it can make up the relevant blank in the research of sociology of law in our country, contribute to the academic inheritance and provide some reference materials for the construction of the socialist legal system. The structure of this paper is divided into three parts. The first part introduces the theoretical origin and the background of qu Tongzu's legal thought, mainly solves the background of qu Tongzu's study of Chinese law and Chinese society, and analyzes the epoch of qu Tongzu's thought under the circumstances of the change of social structure. At that time, historical jurisprudence, sociology of law and other thoughts affected qu Tongzu's formation of sociology of law. The second part discusses the main content of qu Tongzu's legal thought, and studies the basic content of qu Tong's legal thought by analyzing qu Tongzu's works and other related articles. The author holds that qu Tongzu's legal thought is mainly a sociology of law thought, which includes two parts: first, the study of the relationship between Chinese traditional law and society, and the study of the nature and mutual relationship between family law and state law. It is believed that the nature of Chinese traditional society is an identity society, in which the characteristics of Chinese traditional law are ethical law; second, in the process of drawing such a conclusion, Qu Tongzu mainly used the functionalist analysis method and the empirical research method. This paper analyzes these two research methods, and thinks that in studying the legal spirit of the traditional Chinese society for more than two thousand years, The functionalism analysis method has certain superiority, but also has the shortcoming which cannot be ignored. In the empirical analysis method, qu Tongzu has widely used the materials of law, sociology and other disciplines to study and analyze the law in the traditional Chinese society, so as to get the characteristics and spirit of the ancient Chinese law. This is where the later generations have to learn. This part is divided into two chapters to describe, is the focus of this article. The third part analyzes the role of qu Tongzu's legal thought in the perfection of legal system and the study of law in contemporary China, and mainly examines how to treat the function of folk law in the process of perfecting the socialist legal system.
