【摘要】：由于很多人奉行實用主義的法律觀,因而對法律缺乏足夠的尊重和信任,運用法律表現(xiàn)出了隨意性,不想用就走"上訪"、"鬧訪"之路。當"上訪"、"鬧訪"成為嚴重的社會問題以后,直接導致了法律權(quán)威的失落。這表明法治思維和法治方式還沒有成為化解社會矛盾的主要方式,人們的思維方式還存在著諸多的沖突。"我不是潘金蓮"本來是一個道德判斷,由基層社會組織就可以解決,然而卻在現(xiàn)實的法律規(guī)范與道德規(guī)范、法律制度與信訪制度、政府與司法機關(guān)之間來回翻轉(zhuǎn),最終也沒有使矛盾得以化解。這既是個人的悲劇,又是信訪制度、法律制度,乃至于法治的悲哀。
[Abstract]:Because many people follow a pragmatic legal view, they lack sufficient respect and trust for the law, and use the law to show their arbitrariness. If they do not want to use it, they will follow the road of "petition" or "making a visit". When "petition" and "call-up" became serious social problems, it directly led to the loss of legal authority. This shows that the thinking of the rule of law and the way of the rule of law have not become the main way to resolve the social contradictions, and there are still many conflicts in the way of thinking of people. " I am not Pan Jinlian, "originally a moral judgment, which can be solved by grass-roots social organizations, but it turns back and forth between the actual legal norms and moral norms, the legal system and the petition system, and between the government and the judicial organs." In the end, the conflict was not resolved. This is not only the tragedy of the individual, but also the sorrow of the petition system, the legal system and even the rule of law.
