【摘要】：中國傳統(tǒng)文化博大精深，“無訟”思想是其中的一枝奇葩。中國傳統(tǒng)“無訟”思想誕生于百家爭鳴的春秋戰(zhàn)國時代，儒、道、墨、法等流派相互影響，各自形成了對“無訟”的認(rèn)識。隨著漢武帝的“罷黜百家，獨(dú)尊儒術(shù)”，吸收了其他流派思想精華的儒家學(xué)說成為封建社會的正統(tǒng)思想，“無訟”成為中國傳統(tǒng)法律文化的一個重要特征。作為中國傳統(tǒng)法律文化的主導(dǎo)性價值取向，傳統(tǒng)“無訟”思想對中國法治乃至中國社會的發(fā)展產(chǎn)生了深遠(yuǎn)的影響。“無訟”思想的產(chǎn)生有其深刻的經(jīng)濟(jì)、政治、社會和思想文化根源，并在中國的歷史上起過積極的和消極的影響。如何對待這一傳統(tǒng)法律思想，是擺在我們面前的現(xiàn)實(shí)而又迫切的問題。曾經(jīng)，對“無訟”理想的過度追求阻礙了法治在中國的發(fā)展，抑制了人民的權(quán)利，帶來了嚴(yán)重的司法腐敗，是我國近現(xiàn)代社會發(fā)展停滯的重要因素之一。但是，當(dāng)前新形勢下又出現(xiàn)了嚴(yán)重的文化無序、道德失范等一系列社會問題。中國傳統(tǒng)法律文化中的“無訟”思想所蘊(yùn)含的調(diào)解制度與和諧之道恰恰可以有效的規(guī)范和解決這些社會問題。以調(diào)解制度為核心的現(xiàn)代ADR是糾紛解決的不可分割的組成部分，有時甚至發(fā)揮著更加重要而廣泛的影響。而且，“無訟”思想在防止“法律萬能主義”、保障社會的順利轉(zhuǎn)型等方面也起著不可替代的重要作用。構(gòu)建社會主義和諧社會是我們國家的戰(zhàn)略目標(biāo)，“無訟”所追求的境界正是社會的和諧安定有序。本文通過系統(tǒng)分析“無訟”思想及其成因、影響等方面，揭示“無訟”思想的現(xiàn)代價值以及如何實(shí)現(xiàn)創(chuàng)造性轉(zhuǎn)換，，從而為我國的社會主義法治現(xiàn)代化建設(shè)服務(wù)，促進(jìn)社會主義社會的和諧發(fā)展。
[Abstract]:Chinese traditional culture is extensive and profound, and the idea of "no lawsuit" is one of the wonderful flowers. The traditional Chinese thought of "no litigation" was born in the warring States period of the Spring and Autumn period, in which Confucianism, Taoism, Mohism and law influenced each other and formed their own understanding of "no litigation". Along with Emperor Wu's "ousting hundred schools, respecting Confucianism alone", the Confucian theory that absorbed the essence of other schools of thought became the orthodox thought of feudal society, and "no lawsuit" became an important feature of Chinese traditional legal culture. As the dominant value orientation of Chinese traditional legal culture, the traditional idea of "no lawsuit" has exerted a profound influence on the development of China's rule of law and even the development of Chinese society. The emergence of the idea of "no lawsuit" has its profound economic, political, social and ideological and cultural roots, and has played a positive and negative role in the history of China. How to treat this traditional legal thought is a realistic and urgent problem in front of us. Once upon a time, the excessive pursuit of the ideal of "no lawsuit" hindered the development of the rule of law in China, restrained the rights of the people, brought serious judicial corruption, and was one of the important factors for the stagnation of the development of our modern society. However, under the present new situation, a series of social problems such as cultural disorder and moral anomie appear again. The mediation system and the way of harmony contained in the thought of "no lawsuit" in Chinese traditional legal culture can effectively regulate and solve these social problems. Modern ADR, with mediation system as its core, is an integral part of dispute resolution and sometimes plays a more important and extensive role. Moreover, the idea of "no lawsuit" also plays an irreplaceable role in preventing "legal omnipotism" and ensuring the smooth transformation of society. Constructing a harmonious socialist society is the strategic goal of our country. Through systematic analysis of the thought of "no lawsuit" and its causes and influences, this paper reveals the modern value of the thought of "no lawsuit" and how to realize the creative transformation, so as to serve the modernization of socialist rule of law in our country. Promote the harmonious development of socialist society.
