論我國立法聽證參加人制度

【摘要】：立法聽證制度是近年來我國立法領(lǐng)域備受關(guān)注的移植法律制度,地方人大常委會(huì)和政府在立法聽證制度上的積極探索有力地推動(dòng)了國家權(quán)力機(jī)關(guān)立法民主化的步伐。2000年頒布實(shí)施的《中華人民共和國立法法》明文規(guī)定了全國人大常委會(huì)和國務(wù)院在立法過程中可以采用立法聽證會(huì)的形式聽取各方意見,但是在立法聽證規(guī)則方面缺乏全國性的統(tǒng)一規(guī)定,各地自主制定的立法聽證規(guī)則較為粗糙且在相關(guān)制度上規(guī)定各異,全國性的立法聽證會(huì)實(shí)踐經(jīng)驗(yàn)僅有一次,即2005年舉辦的關(guān)于個(gè)人所得稅工薪所得減除費(fèi)用標(biāo)準(zhǔn)的立法聽證會(huì)；地方性的立法聽證會(huì)實(shí)踐經(jīng)驗(yàn)較多,但是聽證會(huì)的質(zhì)量差距較大,對個(gè)案的研究狀況也參差不齊。國內(nèi)對于行政聽證制度研究較多,對價(jià)格聽證和立法聽證的研究較少。在立法聽證制度研究中,專門針對立法聽證參加人的也不多。 第一章從對立法聽證參加人制度的基本理論研究出發(fā),分析了立法聽證與座談會(huì)及聽證會(huì)的區(qū)別,指出現(xiàn)在立法聽證法律依據(jù)的模糊性狀況。現(xiàn)行制度和理論界對于立法聽證參加人的稱謂、外延界定方面都有分歧,本文將聽證人、聽證會(huì)主持人、聽證陳述人及其代理人和旁聽人列入研究范疇,并對立法聽證參加人制度設(shè)置的意義進(jìn)行了介紹和分析。 第二章對立法聽證規(guī)則立法現(xiàn)狀進(jìn)行分析后提出統(tǒng)一明確和規(guī)范立法聽證的法律依據(jù),并對立法聽證人和主持人的合理確定提出建議。 第三章重在分析立法聽證陳述人和旁聽人制度的完善,其中對于聽證陳述人、旁聽人的遴選機(jī)制、權(quán)利和義務(wù)進(jìn)行逐個(gè)分析,并對聽證代理人制度和專家陳述人制度等特殊制度進(jìn)行闡述。通過對已經(jīng)進(jìn)行的聽證會(huì)實(shí)例和有關(guān)地方立法聽證規(guī)則文本的分析,初步梳理出存在的問題,并提出一些有針對性的完善之策。 第四章對于聽證參加人參與程序過程中遇到的實(shí)際問題進(jìn)行補(bǔ)充分析,包括聽證告知制度的完善、聽證發(fā)言制度的完善、聽證辯論制度和聽證結(jié)果四個(gè)版塊。
[Abstract]:The legislative hearing system is a transplant legal system which has attracted much attention in the field of legislation in China in recent years. The active exploration by the standing Committee of the local people's Congress and the government on the system of legislative hearing has powerfully promoted the pace of democratization of the legislation of the state power organs. The Legislative Law of the people's Republic of China promulgated and implemented in 2000 clearly stipulated the people of the whole country. During the legislative process, the NPC standing Committee and the State Council may listen to the views of all parties in the form of legislative hearings. However, there is a lack of a unified national regulation on the rules of legislative hearing, and the rules of legislative hearings formulated by various localities are relatively rough and different in relevant systems. The practice experience of national legislative hearings is only one time. That is, the legislative hearing on the standard of personal income tax income deducting expenses held in 2005; the practice experience of local legislative hearing is more, but the quality gap of the hearing is large, and the research status of individual cases is also uneven. There are more researches on administrative hearing system, less on price hearing and legislative hearing. In the research of legislative hearing system, there are not many people who take part in the legislative hearing. The first chapter analyzes the difference between the legislative hearing and the forum and the hearing, and points out the fuzziness of the legal basis of the legislative hearing from the basic theoretical research on the system of the participants in the legislative hearing. The current system and the theoretical circle have different opinions on the appellation and extension of the participants in the legislative hearings. In this paper, the authors of the hearings, the presenters of the hearings and their agents and observers are included in the scope of the research. The significance of setting up the system of participants in the legislative hearing is also introduced and analyzed. The second chapter analyzes the legislative status quo of the legislative hearing rules, and puts forward the legal basis of unified, clear and standardized legislative hearing, and puts forward some suggestions for the reasonable determination of the legislative hearing person and the moderator. The third chapter focuses on the analysis of the perfection of the system of the speaker and the narrator of the legislative hearing, in which the selection mechanism, rights and obligations of the speaker of the hearing and the observer are analyzed one by one. And the hearing agent system and expert statement system and other special systems are elaborated. Through the analysis of the examples of the hearings and the texts of the hearing rules of the local legislation, this paper preliminarily combs out the existing problems and puts forward some pertinent and perfect measures. The fourth chapter makes supplementary analysis on the practical problems encountered in the process of participants' participation in the hearing, including the perfection of the hearing notification system, the hearing speech system, the hearing debate system and the hearing results.
