【摘要】：招惹規(guī)則屬于德國判例法的一項(xiàng)成果,主要由近50年以來一系列追蹤判例發(fā)展而來。根據(jù)德國聯(lián)邦最高法院的審判要旨,凡以可譴責(zé)的方式,使他人受到招惹,并出于正當(dāng)?shù)膭?dòng)機(jī)實(shí)施某種介入行為,引起風(fēng)險(xiǎn)升高,而且介入的目的與風(fēng)險(xiǎn)處于適度的關(guān)系,則須對所產(chǎn)生的損害承擔(dān)賠償責(zé)任。關(guān)于這一規(guī)則的理論爭鳴主要集中在對"適當(dāng)性"這項(xiàng)構(gòu)成要件的理解、該規(guī)則與其他因果關(guān)系理論的關(guān)系以及它在各種精神中介的因果關(guān)系案例類型中的可適用性。我國侵權(quán)法可以通過吸納德國招惹規(guī)則要求的核心構(gòu)成要件,構(gòu)建一般因果關(guān)系理論上的招惹標(biāo)準(zhǔn),作為相當(dāng)性補(bǔ)充標(biāo)準(zhǔn),用于認(rèn)定相應(yīng)精神中介的因果關(guān)系。
[Abstract]:The rules of provoke belong to a result of the German case law, mainly from a series of follow-up cases developed over the past 50 years. According to the trial gist of the Supreme Court of the German Federal Supreme Court, everyone is provoked in a reprehensible manner, and the risk is raised, and the purpose and risk of intervention are raised. The theoretical contention about this rule is mainly focused on the understanding of the constitutive requirements of "appropriateness", the relationship between the rule and other causality theory and the applicability of it in the causality case types of various spiritual intermediaries. By absorbing the core elements of the requirements of the German provoke rules, the standard of provoke in the theory of general causality is constructed as a complementary standard for determining the causality of the corresponding spiritual intermediary.
