近代中國比較法教育辨正——基于東吳大學(xué)法學(xué)院的考察

【摘要】:以比較法教育作為辦學(xué)方針的東吳大學(xué)法學(xué)院,在近代中國法律教育史中享有很高的地位,歷來為學(xué)界關(guān)注。但至今的研究都沒有注意到該校在比較法教育中存在的諸多問題,例如教員的缺課、學(xué)生對教學(xué)方式的詬病、比較法課程數(shù)量的銳減等,這些現(xiàn)象實際是西方法律教育移植后逐漸本土化過程的反映,也是中央與地方教育自主權(quán)博弈的結(jié)果。比較法課程重要性的降低,教育部及司法院對法學(xué)院發(fā)展的限制,兼職教員微薄的薪資,都對比較法教學(xué)產(chǎn)生了重要影響。解析東吳大學(xué)法學(xué)院比較法教育發(fā)生轉(zhuǎn)變的原因,為反思民國法律教育的得失提供了新的視角。
[Abstract]:The School of Law of Soochow University, which regards comparative law education as its educational policy, enjoys a high status in the history of legal education in modern China and has always been concerned by scholars. However, so far, many problems in comparative law education have not been noticed, such as the absence of teachers, the students' criticism of teaching methods, the sharp decrease in the number of comparative law courses, and so on. These phenomena actually reflect the process of localization after the transplantation of western legal education, and are also the result of the game between central and local educational autonomy. The decrease in importance of comparative law courses, the restrictions on the development of law schools by the Ministry of Education and the School of Justice, and the meagre salary of part-time teachers have had an important impact on the teaching of comparative law. The analysis of the reasons for the change of comparative law education in the Law School of Soochow University provides a new perspective for reflection on the gains and losses of legal education in the Republic of China.
