【摘要】：在土地私有制占支配地位的宋代,利益的多元化孕育并發(fā)展出了形形色色的私有權益,私有財產權成為社會生活中的不爭事實。宋代私有財產權中的"個人"不同于西方,是家庭之私與"倫理個人之私",還有"外商個人之私"。私有制上升為權利須經法律認可與司法保障。在沒有民法典及私法觀念的歷史條件下,宋代法律通過經義、敕令、律典、令典諸方式規(guī)制人們的民事生活,又通過司法保障各種類型的私人財產權利。這種保護既適用于普通民眾,也特別注意對弱勢群體的司法救濟。其彰顯的時代特色風格獨具。
[Abstract]:In the Song Dynasty, where land private ownership dominated, the diversification of interests gave birth to various kinds of private rights and interests, and private property rights became an indisputable fact in social life. The "individual" in the private property right in Song Dynasty is different from the west, it is the private of the family, the private of the ethical individual, and the private of the foreign individual. The rise of private ownership to rights is subject to legal recognition and judicial protection. In the absence of the concept of civil code and private law, the law of the Song Dynasty regulated people's civil life by means of classics, royal decrees, laws and regulations, and protected various types of private property rights through the administration of justice. This protection applies not only to ordinary people, but also to the vulnerable groups of judicial relief. Its distinctive style of the times is unique.
