【摘要】：論文主要采用文獻(xiàn)資料法、歷史分析法,對1929年-1945年間四川地區(qū)推行、實(shí)施《國民體育法》情況進(jìn)行了梳理,以期通過一個(gè)“點(diǎn)”剖析民國時(shí)期體育法律法規(guī)的實(shí)施狀況和存在的問題,從而為當(dāng)下的體育法治建設(shè)提供一定的歷史借鑒。論文選取1929年-1945年四川地區(qū)體育法律法規(guī)的實(shí)施作為研究內(nèi)容,主要基于以下的思考:四川處于中國內(nèi)陸地區(qū),且多山,信息、交通等方面相對來說比較“封閉”,近現(xiàn)代體育的發(fā)展與沿海地區(qū)相比較而言,四川地區(qū)的體育發(fā)展要緩慢一些,并且在四川地區(qū)統(tǒng)一之前,四川境內(nèi)的軍閥混戰(zhàn),給社會(huì)造成了衰敗的現(xiàn)象,體育法律法規(guī)的實(shí)施需要一個(gè)安定的社會(huì)環(huán)境,這就使得其實(shí)施過程中相對困難;抗日戰(zhàn)爭時(shí)期,在1937年隨著國民黨政府內(nèi)遷,重慶在這一時(shí)期處于有利地勢,使得其成為當(dāng)時(shí)中國政治、經(jīng)濟(jì)、文化及教育發(fā)展的中心,受內(nèi)遷文化思潮的影響,體育法律法規(guī)的實(shí)施在這個(gè)時(shí)期得到了較大的推動(dòng),四川在推行實(shí)施體育法律法規(guī)方面具有典型性的特點(diǎn),因此,通過研究1929年-1945年這段時(shí)期體育法律法規(guī)在四川地區(qū)的實(shí)施,可以從側(cè)面反映出近現(xiàn)代中國體育法律法規(guī)的歷史發(fā)展軌跡及其背后的社會(huì)、文化等方面的動(dòng)因,從而為我們理解當(dāng)下《體育法》的推行實(shí)施提供一定的歷史視角及經(jīng)驗(yàn)。論文在分析在1929年-1945年期間四川社會(huì)文化背景的基礎(chǔ)上集中梳理以下幾個(gè)方面的內(nèi)容:一、對1929年-1945年這段時(shí)間四川在體育法律法規(guī)的制定、執(zhí)行等方面進(jìn)行梳理。二、對1929年-1945年這段時(shí)間四川在體育法律法規(guī)實(shí)施的影響下,為了抗戰(zhàn)需要和提高人民的體質(zhì),所開展的各種體育活動(dòng)進(jìn)行梳理。研究發(fā)現(xiàn):1929年-1945年的16年間,四川有一些列的“努力”來推行有關(guān)的規(guī)定,并依據(jù)本省的實(shí)際情況,也制定了一些針對性的規(guī)定,取得了一些成效,也直接推動(dòng)了近現(xiàn)代意義上的體育在四川的進(jìn)一步發(fā)展;在體育活動(dòng)的開展上,四川東部地區(qū)要超過四川西部,但由于其時(shí)社會(huì)整體發(fā)展水平較低,尚不具備依法治理社會(huì)活動(dòng)的條件,因而《國民體育法》等體育法律法規(guī)在四川的推行、實(shí)施的力度和廣度十分有限,有些條款僅止于“紙上”,而對體育活動(dòng)中的問題甚至于糾紛,“關(guān)照”不足等。
[Abstract]:This paper mainly adopts the method of literature and historical analysis to sort out the implementation of "National Sports Law" in Sichuan from 1929 to 1945. Through a "point" to analyze the implementation of sports laws and regulations in the Republic of China and the existing problems, so as to provide a certain historical reference for the construction of sports rule of law. This paper selects the implementation of sports laws and regulations in Sichuan from 1929 to 1945 as the research content, mainly based on the following considerations: Sichuan is located in the inland area of China and is mountainous, information, transportation and other aspects are relatively "closed". Compared with the coastal areas, the development of modern and modern sports in Sichuan is slower, and before the unification of Sichuan, warlords in Sichuan caused a decline in society. The implementation of sports laws and regulations requires a stable social environment, which makes its implementation relatively difficult. During the War of Resistance against Japan, Chongqing was on a favorable terrain during the period of the Anti-Japanese War, when the Kuomintang government moved internally in 1937. It became the center of the political, economic, cultural and educational development of China at that time, and the implementation of sports laws and regulations was greatly promoted during this period. Sichuan has typical characteristics in implementing sports laws and regulations. Therefore, by studying the implementation of sports laws and regulations in Sichuan during the period from 1929 to 1945, It can reflect the historical development track of modern Chinese sports laws and regulations and the social and cultural reasons behind them, thus providing a certain historical perspective and experience for us to understand the implementation of the present Sports Law. On the basis of analyzing the social and cultural background of Sichuan province from 1929 to 1945, the thesis focuses on the following aspects: 1. Combing the formulation and implementation of sports laws and regulations in Sichuan during the period of 1929-1945. Secondly, under the influence of sports laws and regulations from 1929 to 1945, all kinds of sports activities were carried out in Sichuan in order to improve the people's physique and the need of anti-Japanese war. The study found that during the 16 years from 1929 to 1945, Sichuan had some series of "efforts" to carry out the relevant provisions, and according to the actual situation of the province, it also formulated some targeted provisions, and achieved some results. It also directly promoted the further development of sports in Sichuan in the modern and modern sense. In the development of sports activities, the eastern part of Sichuan surpassed the western part of Sichuan, but at that time the overall level of social development was relatively low. There are no conditions for administering social activities according to law. Therefore, the implementation of sports laws and regulations such as the National Sports Law in Sichuan is very limited in intensity and breadth, and some provisions are only "on paper." But to the sports activity question even the dispute, "takes care of" insufficient and so on.
