論我國(guó)法的附則的規(guī)范結(jié)構(gòu)

【摘要】:成文法,特別是現(xiàn)代成文法,就其內(nèi)容的結(jié)構(gòu)和安排來(lái)說(shuō),通常包括總則、分則和附則三個(gè)部分。由于自身內(nèi)容的限制和立法技術(shù)的安排,條文有限的附則一般安置在成文法最后的位置,所以一直沒有引起立法者的重視,也缺乏相應(yīng)的理論研究,導(dǎo)致附則質(zhì)量不盡如人意。存在的主要問題有內(nèi)容混亂,該有的內(nèi)容沒有,或者被安排到總則、分則里;條文安排不合理,缺少必要的邏輯性;內(nèi)容表述也不盡完善,出現(xiàn)諸多漏洞,造成法律自身的不完備,給法律的實(shí)施制造了障礙。事實(shí)上,法的附則并不是可有可無(wú)的,其內(nèi)容中的授權(quán)條款、生效日期等都是法典中必不可少的內(nèi)容,從而對(duì)法的有效實(shí)施起到了保障作用,并有利于實(shí)現(xiàn)實(shí)體公平、程序正義等法的價(jià)值。針對(duì)我國(guó)目前法的附則的立法現(xiàn)狀及存在的問題,解決之道重在提高立法技術(shù)。由于立法是執(zhí)法、司法、守法的起點(diǎn),是保證法律自身質(zhì)量以及順利實(shí)施的關(guān)鍵,提高法的附則的立法技術(shù)是構(gòu)建附則規(guī)范結(jié)構(gòu)的必然選擇。本文是在翻閱大量法律、法規(guī)的基礎(chǔ)上,通過(guò)實(shí)證分析的方法揭示我國(guó)法的附則的立法現(xiàn)狀,分析其存在的問題,并在此基礎(chǔ)上提出完善我國(guó)法的附則的立法技術(shù)之建議。 首先,限定附則的內(nèi)容范圍,附則并非雜則,不是任何內(nèi)容都可以放入附則的,從而限制某些不合理內(nèi)容放入附則,提高其內(nèi)容的科學(xué)性;其次,要規(guī)范附則內(nèi)容的立法表述,立法表述作為法律內(nèi)涵的外部物質(zhì)形態(tài),其將立法思想、立法宗旨、立法政策、立法價(jià)值用嚴(yán)謹(jǐn)、規(guī)范、準(zhǔn)確的語(yǔ)言表達(dá)出來(lái)。只有形成嚴(yán)格的立法表述規(guī)則,運(yùn)用好將觀念中的立法政策轉(zhuǎn)化為文字符號(hào)的唯一途徑,才能制造出高質(zhì)量的“法律產(chǎn)品”;再次,是合理安排條文的邏輯順序,邏輯反映了思維的清晰程度,合理的邏輯順序不但符合人們認(rèn)識(shí)事物的規(guī)律,也有利于認(rèn)識(shí)、理解法律本身,并有利于法律的施行,從而維護(hù)了國(guó)家法律體系的有序運(yùn)轉(zhuǎn),這一規(guī)范的根本屬性決定了法律規(guī)范必須具備嚴(yán)謹(jǐn)?shù)倪壿嬳樞颉?本文寫作的目的是探求一條更加簡(jiǎn)便、高效且規(guī)范化的道路,為我國(guó)法的附則的制定帶來(lái)些許啟發(fā),從而提高附則的立法質(zhì)量,為現(xiàn)實(shí)的需要提供一定的理論指導(dǎo)。
[Abstract]:In terms of the structure and arrangement of its content, statutory law, especially modern statute, usually includes three parts: general rule, subclause and supplementary provision. Due to the limitation of its content and the arrangement of legislative technology, the limited by-laws are generally placed in the final position of statutory law, so they have not attracted the attention of legislators and lack of corresponding theoretical research, which leads to the unsatisfactory quality of the by-laws. The main problems that exist are the confusion of the content, the fact that some of the contents should not be or are arranged into the general rules and sub-rules; the unreasonable arrangement of the articles and the lack of necessary logic; and the incomplete presentation of the contents, resulting in many loopholes. The law itself is not perfect, creating obstacles to the implementation of the law. In fact, the supplementary provisions of the law are not dispensable. The enabling clauses and the effective date of the law are all indispensable contents in the code, which plays an important role in the effective implementation of the law and is conducive to the realization of substantive equity. The value of law such as procedural justice. In view of the current legislative situation and existing problems of the subsidiary provisions of our country, the key to solve this problem is to improve the legislative technology. Since legislation is the starting point of law enforcement, judicature and law-abiding, it is the key to guarantee the quality and smooth implementation of the law itself, so the legislative technology to improve the subsidiary provisions of the law is the inevitable choice to construct the normative structure of the by-laws. On the basis of reading a large number of laws and regulations, this paper reveals the legislative status of the supplementary provisions of Chinese law through the method of empirical analysis, analyzes the existing problems, and puts forward some suggestions for perfecting the legislative techniques of the supplementary provisions of Chinese law. First, to limit the scope of the contents of the supplementary provisions, the supplementary provisions are not miscellaneous, not any content can be put into the supplementary provisions, so as to limit some unreasonable content into the supplementary provisions, to improve the scientific nature of its content; second, to regulate the legislative expression of the contents of the supplementary provisions, Legislative expression, as the external material form of legal connotation, expresses the legislative thought, legislative purpose, legislative policy and legislative value in precise, standardized and accurate language. Only by forming strict legislative expression rules and using the only way to transform the legislative policy in the concept into literal symbols can we produce high-quality "legal products". Thirdly, it is the logical order of the articles that can be rationally arranged. Logic reflects the degree of clarity of thinking. A reasonable logical sequence not only conforms to the laws of people's understanding of things, but also helps to understand and understand the law itself, and is conducive to the implementation of the law, thus maintaining the orderly operation of the national legal system. The fundamental attribute of this norm determines that the legal norm must have strict logical order. The purpose of this paper is to explore a more convenient, efficient and standardized way, to bring some inspiration to the formulation of the supplementary provisions of Chinese law, thus to improve the legislative quality of the by-laws, and to provide certain theoretical guidance for the needs of reality.
