【摘要】：在"一帶一路"倡議的戰(zhàn)略構(gòu)想中,法律發(fā)揮重要作用。從比較法角度,敘述美國(guó)20世紀(jì)先后兩次開(kāi)展的"法律與發(fā)展運(yùn)動(dòng)"的經(jīng)驗(yàn)和教訓(xùn),對(duì)我國(guó)的法律域外發(fā)展不無(wú)借鑒意義。本文通過(guò)比較,指出兩種全球法律移植安排之間存在三點(diǎn)相似性和四點(diǎn)差異性。其相似性為,兩種戰(zhàn)略都是在經(jīng)濟(jì)上的強(qiáng)勢(shì)國(guó)家主導(dǎo),都帶有法律內(nèi)容,都正在或即將迎來(lái)批判和檢驗(yàn);其差異性在于,中美兩國(guó)的歷史處境和國(guó)際地位不同,法律現(xiàn)代化的成熟程度不同,所涉及法律文化的復(fù)雜性不同,既有經(jīng)驗(yàn)和理論預(yù)設(shè)不同。基于此,在"一帶一路"的法律移植中,我國(guó)應(yīng)回答五個(gè)相關(guān)核心問(wèn)題,并避免線性法律與發(fā)展觀,法律工具主義觀,隱性殖民主義觀,"中國(guó)模式"完美論和萬(wàn)能論及法律移植的意識(shí)形態(tài)觀五個(gè)觀念陷阱。"一帶一路"倡議為我國(guó)比較法學(xué)的發(fā)展提供了歷史機(jī)遇,我國(guó)比較法學(xué)研究應(yīng)突破傳統(tǒng)"中—西"二元對(duì)立的比較格局,突破過(guò)去以概念比較和功能比較為主要方法的方法論體系,有意識(shí)地革新比較法教學(xué)體系,為中國(guó)法的全球化提供戰(zhàn)略儲(chǔ)備人才。
[Abstract]:The law plays an important role in the strategic vision of the Belt and Road initiative. From the perspective of comparative law, this paper describes the experiences and lessons of the "Law and Development Movement" carried out by the United States two times in the 20th century, which is of great significance to the extraterritorial development of our country's laws. This paper points out that there are three similarities and four differences between the two global legal transplant arrangements. The similarities are that the two strategies are dominated by strong countries in economic terms, both have legal content, are being or will soon be criticized and tested, and the difference lies in the fact that the historical situation and international status of China and the United States are different. The maturity of legal modernization is different, the complexity of legal culture is different, and the experience and theoretical presupposition are different. Based on this, in the legal transplant of "Belt and Road", our country should answer five relevant core questions, and avoid linear law and development view, legal instrumentalism view. There are five pitfalls in the concept of recessive colonialism, the perfect theory of the Chinese model and the ideological view of omnipotence and the transplantation of law. " The "Belt and Road" initiative provides a historical opportunity for the development of comparative law in China. This paper breaks through the methodology system of concept comparison and function comparison in the past, innovates the teaching system of comparative law consciously, and provides strategic reserve talents for the globalization of Chinese law.
