【摘要】：流刑是指“將犯人發(fā)遣到邊遠(yuǎn)區(qū)域服勞役,并要求不得離開(kāi)的刑罰制度”。(1)其實(shí),流刑制度源于原始社會(huì)的流放。此后,流刑歷經(jīng)各朝的傳承和發(fā)展,于北朝時(shí)正式寫(xiě)進(jìn)律法,與此同時(shí),被列入封建制五刑�！白蕴埔韵�,歷代相沿,莫之改也”。(2)要知道,流刑是封建制五刑中僅次于死刑的重刑。因此,在我國(guó)古代的刑罰體系之中,我們可以認(rèn)為,流刑制度是比較重要的刑罰制度之一。本文立足于唐代的婦女流刑制度,綜合運(yùn)用歷史分析方法和案例研究方法,分析唐代婦女流刑制度的淵源、犯罪種類、原則、執(zhí)行程序以及得以依存的社會(huì)基礎(chǔ)。文章主要從以下幾個(gè)部分加以闡述:第一部分引言,主要論述了選題意義、國(guó)內(nèi)外研究綜述和研究方法;第二部分,對(duì)中國(guó)唐代流刑制度的發(fā)展變化的歷程進(jìn)行了基本的梳理;第三部分,從犯罪緣由方面對(duì)唐代婦女流刑制度進(jìn)行探討,主要從唐代婦女流刑的犯罪種類、原則和執(zhí)行程序方面進(jìn)行分析;第四部分則是根據(jù)以上對(duì)于唐代婦女流刑制度的詳細(xì)介紹的基礎(chǔ)上,總結(jié)出唐代婦女流刑制度得以繼續(xù)存在的社會(huì)基礎(chǔ),主要是從政治、經(jīng)濟(jì)、倫理等因素來(lái)深入分析;第五部分,是對(duì)唐代婦女流刑制度的總結(jié)以及對(duì)現(xiàn)代的思考。
[Abstract]:Floating punishment refers to the penalty system of sending prisoners to remote areas and demanding not to leave. In fact, the system originated from exile in primitive society. Since then, the flow of torture after the inheritance and development of each dynasty, in the Northern Dynasty was formally written into the law, at the same time, was included in the feudal five sentences. "since the Tang Dynasty, successive dynasties along, Mozhihua also". 2) should know that the flow penalty is second only to the death penalty in the feudal five severe punishment. Therefore, in the ancient Chinese penalty system, we can think that the floating penalty system is one of the more important penalty system. Based on the system of women's floating punishment in Tang Dynasty, this paper analyzes the origin, kinds of crimes, principles, executive procedures and the social basis of dependency of the system of women's floating punishment in Tang Dynasty by using the historical analysis method and the case study method. The article mainly elaborates from the following several parts: the first part preface, mainly elaborated the topic significance, the domestic and foreign research summary and the research method, the second part, has carried on the basic comb to the Chinese Tang Dynasty flow penalty system development change course; The third part, from the crime reason aspect carries on the discussion to the Tang Dynasty woman flow punishment system, mainly carries on the analysis from the Tang Dynasty woman floating punishment crime type, the principle and the execution procedure aspect; The fourth part is based on the above detailed introduction of the Tang Dynasty women floating punishment system, summed up the Tang Dynasty women floating punishment system to continue to exist social basis, mainly from the political, economic, ethical and other factors to in-depth analysis; The fifth part is the summary of Tang Dynasty women floating punishment system and modern thinking.
