【摘要】：命令說將規(guī)范視為自上而下發(fā)出的、以制裁為威脅的命令,回避了規(guī)范本身的合理性問題。規(guī)則理論認(rèn)為,命令說僅僅從外在視角出發(fā),實(shí)質(zhì)上是將規(guī)范視為是一種關(guān)于"行為"與"制裁"之聯(lián)系的預(yù)測(cè)工具,忽視了規(guī)范本應(yīng)該具有的內(nèi)在面向,即其是人們予以"接受"的行為規(guī)則。而這種對(duì)規(guī)范予以"接受"的心理狀態(tài)不同于人們出于生物本能的、對(duì)規(guī)范的"內(nèi)化"狀態(tài),它意味著在規(guī)范性討論中對(duì)相關(guān)"規(guī)范"的真誠(chéng)主張,對(duì)人們就規(guī)范達(dá)成共識(shí)期待和對(duì)失范導(dǎo)致不利后果的真心認(rèn)可。這一主張將"規(guī)范"與"合理性"密切聯(lián)系了起來。
[Abstract]:An order that regards the norm as a top-down order threatening sanctions evades the reasonableness of the norm itself. According to the rule theory, the order theory, which only starts from an external perspective, regards norms as a predictor of the relationship between "behavior" and "sanctions" in essence, neglecting the inherent orientation that the norm should have. That is to say, it is the behavior rule that people "accept". This psychological state of "accepting" norms is different from the "internalized" state of norms, which is derived from biological instinct. It means the sincere proposition of relevant "norms" in normative discussions. To people to reach consensus on the norm and bad results due to the true acceptance of the norm. This proposition is closely related to "norm" and "rationality".
