【摘要】：以現(xiàn)代邏輯重組孔子的法律哲學體系至為重要。用現(xiàn)代法學思維考察孔子對法律的理解,刑罪與獄訟為分析法學下的實在法,禮與樂為社會法學下的法律規(guī)則,仁與義為自然法學下的高級法。刑罰—禮樂—仁義構成了孔子法律思想的基本結構,類似于西方實在法—社會規(guī)范—價值追求的一般思想模式。通過考察西方學者如孟德斯鳩、昂格爾和韋伯眼中的禮與法,以此來探究東西方法律文化的差異。就公正而言,拿西方正義的模式作為參照,《論語》里的公正近似于早期基督教式的利他主義道德,接近于康德式的道德哲學,不同于邊沁式的功利主義。
[Abstract]:It is very important to reorganize Confucius' legal philosophy system with modern logic. In this paper, Confucius' understanding of law is investigated with modern legal thinking. Criminal and prison litigation is the analysis of positive law under jurisprudence, ritual and music are the legal rules under social jurisprudence, and benevolence and righteousness are the advanced laws under natural law. Penalty, rites, music and benevolence constitute the basic structure of Confucius' legal thought, which is similar to the general thought mode of western positive law-social norm-value pursuit. By examining the views of western scholars such as Montesquieu, Angell and Weber, the differences of legal culture between East and West are explored. As far as justice is concerned, taking the model of western justice as a reference, justice in Analects of Confucius is similar to the early Christian altruistic morality, close to Kant's moral philosophy, and different from Bentham's utilitarianism.
