【摘要】：中華法系源遠(yuǎn)流長(zhǎng),從四千多年前的夏王朝至清末修律,中華法系以其博大精深的體系構(gòu)化,系統(tǒng)完善的制度建設(shè),保證著中華民族生生不息,屹立于世界民族之林。然而,在近代,中國(guó)被帝國(guó)主義大肆侵略,社會(huì)經(jīng)濟(jì)文化遭受重創(chuàng),社會(huì)觀念與意識(shí)形態(tài)發(fā)生了根本性的變化。在此條件下,中華法系也走向了衰亡與瓦解。在當(dāng)今,中華法系多被作為歷史概念而研究,對(duì)于現(xiàn)實(shí)的可借鑒性并未引起足夠的重視,而作為中華法系一部分的少數(shù)民族法律系統(tǒng)更是沒(méi)有得到應(yīng)有的研究和重視。 南詔國(guó)是唐朝中后期地處云南邊陲的一個(gè)多民族的少數(shù)民族政權(quán),在云南歷史的發(fā)展中起著承上啟下的重要作用。在云南的歷史上,古滇國(guó),南詔國(guó),大理國(guó)都是留下文物文獻(xiàn)較多的地方性政權(quán),研究它們的歷史對(duì)了解云南的政治、經(jīng)濟(jì)、文化發(fā)展過(guò)程有著巨大作用。南詔國(guó)的刑事法律發(fā)展相對(duì)成熟,同時(shí)它的發(fā)展過(guò)程也是中原法律文化第一次對(duì)云南邊疆地區(qū)刑事法律規(guī)范產(chǎn)生全面而深刻的影響過(guò)程。 南詔國(guó)的法律體系可以看做是中華法系的一個(gè)分支,其在唐代云南地區(qū)孕育而生,又帶有明顯的向唐律靠近的趨向性,其刑事律法,極具特色。從其刑事法律規(guī)范的產(chǎn)生,到刑事法律規(guī)則的構(gòu)建,再到刑事法律民族化的成就,可以說(shuō),南詔國(guó)刑事法律不只是唐代民族法律的成就,更是我們中華法系成長(zhǎng)初期的一個(gè)再現(xiàn)和縮影。 筆者在研究中,通過(guò)對(duì)大量史料的閱讀,認(rèn)真總結(jié),運(yùn)用少數(shù)民族法制史學(xué)的基本研究方法對(duì)史料進(jìn)行篩選與研究,最終將南詔國(guó)刑事法律體系作一個(gè)初步完整的呈現(xiàn)。筆者認(rèn)為,南詔國(guó)的刑事法律代表著唐代云南地區(qū)立法的最高水平,其刑事立法與司法注重因地制宜,民族有別,使當(dāng)時(shí)多層次的民族特征較好的融入進(jìn)了刑事法律當(dāng)中,從而使南詔國(guó)獲得了百年的穩(wěn)定與發(fā)展。南詔國(guó)刑事法律的成功對(duì)于當(dāng)今云南少數(shù)民族地區(qū)立法司法體制的建設(shè),有著重要的借鑒意義。
[Abstract]:The Chinese legal system has a long history, from the Xia Dynasty to the late Qing Dynasty more than 4,000 years ago, the Chinese law system with its extensive and profound system structure, systematic and perfect system construction, ensure the Chinese nation to live, stand erect in the world nation. However, in modern times, China was severely invaded by imperialism, the social economy and culture suffered heavy losses, and the social concept and ideology underwent fundamental changes. Under this condition, the Chinese legal system also went to decline and disintegrate. Nowadays, the Chinese legal system is mostly studied as a historical concept, and the reference to the reality has not been paid enough attention to, and the minority legal system, which is part of the Chinese legal system, has not received the due research and attention. Nanzhao is a multi-ethnic minority regime in the middle and late Tang Dynasty, which plays an important role in the development of Yunnan history. In the history of Yunnan, ancient Yunnan, Nanzhao and Dali were all local regimes which left more cultural relics, and the study of their history played a great role in understanding the political, economic and cultural development of Yunnan. The development of Nanzhao's criminal law is relatively mature, and its development process is the first time that the legal culture of the Central Plains has exerted a comprehensive and profound influence on the criminal legal norms in Yunnan's frontier areas. The legal system of Nanzhao can be regarded as a branch of the Chinese legal system. From the emergence of its criminal legal norms, to the construction of criminal law rules, and to the achievements of nationalization of criminal law, it can be said that the criminal law of Nanzhao is not only the achievement of national law in Tang Dynasty. It is also a reproduction and microcosm of our Chinese legal system at the beginning of its growth. In the research, the author, through reading a large number of historical data, conscientiously summarizing, using the basic research method of minority legal history to screen and study the historical data, finally make a preliminary and complete presentation of the criminal law system of Nanzhao. The author thinks that the criminal law of Nanzhao country represents the highest level of legislation in Yunnan in Tang Dynasty, and its criminal legislation and judicature pay attention to suit measures to local conditions and different nationalities, so that the multi-level national characteristics at that time were better integrated into the criminal law. So that Nanzhao country achieved a hundred years of stability and development. The success of Nanzhao's criminal law is of great significance to the construction of the legislative and judicial system in Yunnan minority areas.
