【摘要】：密爾是19世紀英國著名的自由主義思想家,其思想是時代與人生的哲學(xué)反映。他的自由主義思想繼承了傳統(tǒng)自由主義的思想內(nèi)核,但又立足于當(dāng)時具體的政治社會環(huán)境,為民主時代的個人自由做出了最充分的辯護。他擔(dān)心“多數(shù)人暴政”,擔(dān)心社會的整齊劃一與輿論專制,主張思想自由、個性解放與保持社會的多樣性,并且將自由、個性與社會進步有機的結(jié)合起來。密爾的自由哲學(xué)體系存在著自由與功利之間內(nèi)部張力,但他對自由的理解是多元和立體的,不僅將自由做為一種達至社會進步的手段,而且將自由至于最終的目的,成功的化解了其自由主義法律思想體系中的自由與功利之間的邏輯沖突,為維護個人自由這一傳統(tǒng)自由主義的核心理念發(fā)出了最振聾發(fā)聵的聲音。 作為自由主義史上承前啟后的思想家,密爾善于不斷結(jié)合歷史發(fā)展的規(guī)律與經(jīng)驗提升自己的思想深度。針對古典自由主義在理論與實踐上面臨的歷史困境與道德難題,他親身參與政治實踐,勇于反思當(dāng)下,對當(dāng)時自由社會的代議民主制與經(jīng)濟基礎(chǔ)這兩個方向提出理論上的修正,從而讓自己的自由主義理論變得更加生動豐滿和飽含深情。這個修正成就了古典自由主義向新自由主義的過渡。 當(dāng)前中國正處于社會轉(zhuǎn)型期,而密爾自由主義法律思想對處于這一大背景下的我國法制建設(shè)與完善具有重要啟示意義。
[Abstract]:Mill is a famous British liberalism thinker in the 19 th century, whose thought is the philosophical reflection of time and life. His liberal thought inherited the core of traditional liberalism, but based on the specific political and social environment at that time, he made the most full defense for the individual freedom in the democratic era. He was worried about "tyranny of the majority", about the uniformity of society and the autocracy of public opinion, advocated the freedom of thought, the liberation of individuality and the preservation of social diversity, and organically combined freedom, individuality and social progress. There is an internal tension between freedom and utilitarianism in Mill's system of liberal philosophy, but his understanding of freedom is pluralistic and three-dimensional, not only as a means to social progress, but also as the ultimate goal. It successfully resolves the logical conflict between freedom and utilitarianism in his legal system of liberalism, and makes the most enlightening sound for the maintenance of personal freedom, which is the core idea of traditional liberalism. As a thinker in the history of liberalism, Mill is good at improving his ideological depth by combining the law and experience of historical development. In view of the historical dilemma and moral difficulties faced by classical liberalism in theory and practice, he took part in political practice, dared to reflect on the present, and put forward theoretical amendments to the two directions of representative democracy and economic foundation of the free society at that time. In order to make their own theory of liberalism more vivid and full of deep feelings. This amendment made the transition from classical liberalism to neoliberalism. At present, China is in the period of social transformation, and Mill's liberal legal thought is of great significance to the construction and perfection of China's legal system under this background.
