【摘要】：2009年5月,日本裁判員制度開始正式實施。裁判員制度是國民親身參與刑事審判,與合議法官一同認定案件事實,共同作出有罪、無罪的判斷以及若作有罪判斷應判處何種刑罰的制度。日本引入裁判員制度,是藉由國民參與司法,讓健全的社會常識能反映到司法中,從而促使司法民主實質化,增強國民對司法的理解與信賴。裁判員制度作為日本司法改革中的三大支柱之一,是一種新創(chuàng)制的制度。筆者認為,研究日本裁判員制度對完善我國人民陪審員制度有一定的借鑒意義。 本文共分四個部分。 文章第一部份首先介紹日本裁判員制度的歷史發(fā)展過程。裁判員制度的發(fā)展過程可以分成三個階段:第一階段是日本陪審制度的起源。陪審制從慶興2年(1866年)開始為日本國民所認識,之后在明治初年的制憲中引起了日本國內的廣泛討論。第二階段是陪審制度的發(fā)展。1910年代到1920年代“大正民主政體”時期,在掌權者的推動下,1923年日本以美國陪審制為藍本制定了《陪審法》。但陪審法最終因各種原因在1943年被停止適用。第三階段是裁判員制度的引入。裁判員制度是作為日本實現(xiàn)國民參與司法的形式而設置的。2004年5月裁判員法正式得到通過后,日本用了五年的時間從法規(guī)的配備、人力物力及社會環(huán)境的整備、國民的理解等方面做了充分的準備,于2009年5月21日正式開始實施。 第二部分集中介紹了裁判員制度的內容。內容主要涉及九個方面,一是裁判員制度適用的案件范圍,二是合議庭的構成,三是法官與裁判員的權限,四是裁判員的資格限制,五是裁判員的選任流程,六是裁判員的義務與解任,七是裁判員參與審判的程序,八是區(qū)分審理,九是對裁判員的保護措施及處罰規(guī)定。 第三部分著重闡述了日本引入裁判員制度對日本刑事司法的影響。在控訴制度方面,日本為了使裁判員制度在司法實踐中真正發(fā)揮作用,偵查階段嘗試實行偵查可視化。同時裁判員制度的實施,也將會給日本保釋制度帶來一定的影響。《檢察基本方針》對檢察官在庭審中的主張和舉證提出了簡潔易懂、迅速、準確反映案件本質三點原則性要求,要求檢察官在審前做好充分的準備,在庭審中可以根據(jù)情況靈活采用一定的輔助有段。裁判員制度對辯護制度的影響,一是適用國選律師制度的范圍擴大,由過去的僅限于刑事被告擴大到被疑人。二是裁判員制度的實施,使律師更加注重庭前準備以及庭審上的情節(jié)辯護。對日本審判程序方面的影響,主要是庭審環(huán)境的改變、審前整理程序的增加、以及庭審過程的充實。 第四部分則是在對日本裁判員制度有一個較為完整的介紹的基礎上,探討裁判員制度對我國人民陪審員制度完善的借鑒意義。一是制定《人民陪審員法》,筆者認為,不僅可以借鑒日本裁判員法的內容,同時也借鑒日本在裁判員法制定時以及制定后做法。二是借鑒日本裁判員制度,在人民陪審員的選任、權利義務以及保護規(guī)定等方面加以完善。三是完善配套制度,引入庭前爭點整理以及證據(jù)開始程序,確立一系列的庭審原則,從而確保人民陪審員制度真正落實到實踐中。
[Abstract]:In May 2009 , the Japanese referee system began to be formally implemented . The referee system is the system of people ' s personal participation in the criminal trial , and with the judge judge the facts of the case , the common conviction , the non - crime judgment and the system of what punishment should be imposed if the judge is guilty . Japan introduces the referee system , which makes the judicial democracy essence and strengthens the understanding and trust of the national to the judiciary . The referee system is one of the three pillars in the judicial reform of Japan , and is a new system . The author thinks that the study of the Japanese referee system has certain reference significance to the improvement of the system of the people ' s jury system in China .

This paper is divided into four parts .

The first part of this article introduces the historical development process of Japanese referee system . The development process of the referee system can be divided into three stages : the first stage is the origin of Japanese jury system .

The second part focuses on the contents of the referee system , which mainly involves nine aspects , one is the scope of cases applied by the referee system , the second is the composition of the judge and the judge , the third is the judge and the judge ' s authority , the fourth is the judge ' s qualification limit , the fifth is the judge ' s election process , the sixth is the judge ' s duty and the discharge , the seventh is the judge ' s procedure of participation in the trial , the eighth is to distinguish the trial , 9 is the judge ' s protective measures and punishment provisions .

The third part focuses on the influence of Japan ' s introduction of the referee system on the criminal justice of Japan . In the aspect of the prosecution system , in order to make the referee system play a real role in judicial practice , the investigation stage tries to carry out investigation visualization .

The fourth part , on the basis of a more complete introduction to the Japanese referee system , discusses the significance of the referee system to the perfection of our people ' s jury system .
