【摘要】：中國式鄰避困局的根源在于三個方面:一是功能錯位的政企關(guān)系,二是權(quán)力扭曲的政社關(guān)系,三是責任缺失的企社關(guān)系。同時,在法律層面,中國城市社區(qū)鄰避治理存在三大問題:一是缺乏精細化的法律防控體系,二是過度依賴行政治理的力量,三是采取壓制型法模式來應(yīng)對鄰避問題。破解上述中國式鄰避困局的關(guān)鍵是充分保障公民權(quán)利,因此,需要當前社會治理模式的法律轉(zhuǎn)型:從立法至上、行政主導(dǎo)的社會治理轉(zhuǎn)變?yōu)槎嘣髁x、司法中心的社會治理范式,通過激活權(quán)利改變治理結(jié)構(gòu),構(gòu)建精細化的法律治理體系,充分回應(yīng)公民的權(quán)利訴求,從而降低鄰避沖突的社會-政治風(fēng)險。
[Abstract]:The root of the Chinese way of avoiding difficulties lies in three aspects: one is the relationship between government and enterprise with misplaced functions, the other is the relationship between government and society with distorted power, and the third is the relationship between enterprise and society without responsibility.At the same time, at the legal level, there are three major problems in the adjoining governance of urban communities in China: one is the lack of a fine legal prevention and control system, the other is the excessive reliance on the power of administrative governance, and the third is the adoption of a repressive law model to deal with the problem of neighborhood avoidance.The key to solve the above difficulties is to fully protect the rights of citizens. Therefore, we need the legal transformation of the current social governance model: from legislative supremacy, executive-led social governance to pluralism.The social governance paradigm of the judicial center, by activating the right to change the governance structure, to build a fine legal governance system, fully respond to the rights of citizens, so as to reduce the socio-political risk of conflict avoidance.
