【摘要】：依法治國(guó)作為一種中國(guó)式的法治與文化,是從中國(guó)固有的文化傳統(tǒng)中生長(zhǎng)起來(lái)的。具體地說(shuō),依法治國(guó)是先秦法家的以法治國(guó)吸納了西方傳來(lái)的法治文化的產(chǎn)物。從文化傳承的角度看,從先秦法家的以法治國(guó)到當(dāng)代中國(guó)的依法治國(guó),是一條持續(xù)不斷的文化主流。從文化交往的角度看,西方法治文化是19世紀(jì)末期匯入中國(guó)文化主流的。相對(duì)于西方匯入的法治文化而言,先秦法家的以法治國(guó)構(gòu)成了依法治國(guó)的文化源頭。較之于西方傳來(lái)的法治文化,先秦法家的以法治國(guó)更有力地塑造了當(dāng)代中國(guó)的法治形態(tài),那就是當(dāng)代中國(guó)的依法治國(guó)。
[Abstract]:The rule of law, as a Chinese-style rule of law and culture, grew from the Chinese inherent cultural tradition.To be specific, the rule of law is the product of the rule of law culture from the west.From the perspective of cultural inheritance, from the rule of law of the pre-Qin legalists to the rule of law in contemporary China, it is a continuous cultural mainstream.From the angle of cultural communication, the western culture of rule of law was merged into the mainstream of Chinese culture in the late 19 th century.Compared with the western culture of rule of law, the rule of law by law constituted the cultural source of governing the country according to law.Compared with the culture of rule of law from the west, the rule of law of the pre-Qin legalists shaped the rule of law in contemporary China more forcefully, that is, the rule of law in contemporary China.
