本文選題：問題意識(shí)　切入點(diǎn)：法學(xué)論文寫作　出處：《探索與爭(zhēng)鳴》2017年05期

【摘要】：那種按照教科書式體例撰寫的法學(xué)論文,其最大的弊病在于"有論域而無論題",亦即只是選定了一個(gè)研究領(lǐng)域、對(duì)象或范圍進(jìn)行面面俱到的介紹和敘述,卻沒有從中提煉出一個(gè)中心論題貫穿全文始終并加以論證。教科書式的寫作風(fēng)格在今天仍然頑強(qiáng)乃至頑固地繼續(xù)影響著法學(xué)論文的寫作,這在很多題為"××制度研究"或"論××制度"的碩博士學(xué)位論文當(dāng)中體現(xiàn)得尤其明顯。之所以仍然存在這種現(xiàn)象,很大程度上是與對(duì)問題意識(shí)的重視不夠和認(rèn)識(shí)誤區(qū)有關(guān),特別是沒有充分意識(shí)到問題(question)、論題(problem)和命題(issue)之間的區(qū)別。對(duì)于如何提煉問題意識(shí)這一問題的思考,可以圍繞"書本知識(shí)VS.社會(huì)實(shí)踐""歷史視野VS.現(xiàn)實(shí)關(guān)懷"和"中國意識(shí)VS.國際視野"這三組概念展開。
[Abstract]:The biggest drawback of a legal paper written according to a textbook style is that it has a field of discussion without a topic, that is, it only selects a research field, object or scope for comprehensive introduction and narration.But did not extract a central topic throughout the full text and to demonstrate.The style of textbook writing is still stubbornly affecting the writing of legal papers today, which is especially evident in many doctoral theses entitled "study of 脳 脳 system" or "on 脳 脳 system".The reason why this phenomenon still exists, to a large extent, is related to the lack of attention to the problem consciousness and the misunderstanding of understanding, especially the lack of awareness of the difference between the question question (problem) and the proposition (issue).Thinking about how to refine problem consciousness can revolve around book knowledge VS.Social practice.Realistic concern and Chinese consciousness VS.International Vision, the three sets of concepts.
