【摘要】:大學(xué)法,以大學(xué)為本位,是大學(xué)教育的基本法,對大學(xué)教育發(fā)展具有導(dǎo)向作用,反映著大學(xué)教育發(fā)展最基本的原則和精神。對贊比亞共和國而言,自國家創(chuàng)立第一所大學(xué)起,就非常重視大學(xué)的法制建設(shè)。在獨(dú)立后的近半個世紀(jì)里,更是堅持不斷地適時修訂,努力把握時代的所需。大學(xué)法的修訂與大學(xué)教育的反思,一直是贊比亞大學(xué)教育發(fā)展過程中最為迫切的課題之一;趯Υ髮W(xué)法研究價值的拷問,本文以贊比亞共和國大學(xué)法為研究對象,運(yùn)用文本分析法、歷史分析法及比較分析法對其變遷的歷程及內(nèi)容進(jìn)行梳理和分析?傮w上,研究以大學(xué)法的變遷為視角,全面了解贊比亞共和國大學(xué)法的變遷走向及大學(xué)改革與發(fā)展的歷程,在此基礎(chǔ)上,也希望能為我國的大學(xué)法制建設(shè)提供一點(diǎn)啟發(fā)。 全文除緒論外,主要分為四個部分。第一部分是贊比亞殖民地時期的法律制度與教育的研究。研究主要挖掘殖民地時期贊比亞國家的法律制度及其教育的發(fā)展?fàn)顩r,分析該時期當(dāng)?shù)胤审w系的特點(diǎn)及殖民地背景對贊比亞教育長期落后產(chǎn)生的影響。第二部分是國家獨(dú)立至20世紀(jì)80年代末贊比亞共和國大學(xué)法的研究。研究在簡要回顧贊比亞第一共和國及第二共和國時期大學(xué)法制定與修訂的基礎(chǔ)上,進(jìn)一步探討大學(xué)的創(chuàng)立史及大學(xué)宏觀管理體制的變遷歷程。第三部分是20世紀(jì)90年代以來贊比亞共和國大學(xué)法的研究。研究主要分別分析《1992年大學(xué)法》和《1999年大學(xué)法》的修訂背景與修訂內(nèi)容,在此基礎(chǔ)上,進(jìn)一步探討兩部大學(xué)法帶來的大學(xué)內(nèi)部治理結(jié)構(gòu)的規(guī)范與完善,全面分析21世紀(jì)以來私立大學(xué)的迅速發(fā)展和公立大學(xué)的改革發(fā)展。第四部分是本文的總結(jié)和思考。研究在綜合分析大學(xué)法變遷史的基礎(chǔ)上,總結(jié)贊比亞共和國大學(xué)法的總特征、大學(xué)法的內(nèi)容變遷與修訂原則及其變遷的未來走向。研究最后也對我國《高等教育法》進(jìn)行了思考,從立法和執(zhí)法兩方面反思我國《高等教育法》,提出完善我國高等教育法案的建議。 研究得出的結(jié)論主要有:1.大學(xué)教育發(fā)展的內(nèi)在需要及大學(xué)教育本身所具有的重要意義決定了大學(xué)法治的必要。雖然大學(xué)法無法完全解決大學(xué)問題而達(dá)到社會要求的目標(biāo),但是,以其為大學(xué)政策決定的基礎(chǔ)引導(dǎo)大學(xué)的發(fā)展,是非常必要的。2.贊比亞共和國大學(xué)法最為明顯的特征就是順應(yīng)形勢頻繁修訂,修訂趨勢為從大學(xué)管理體制的頂層設(shè)計走向大學(xué)內(nèi)部治理結(jié)構(gòu)的規(guī)范,為大學(xué)在客觀的法律保護(hù)之下形成自主健康發(fā)展的環(huán)境,但其作用的發(fā)揮更需要整個社會的穩(wěn)定給予保障。3.作為我國高等教育基本法的《高等教育法》,應(yīng)該是規(guī)范與保障我國高等教育活動的重要大法。為讓我國《高等教育法》成為一部真正引領(lǐng)高等教育改革與發(fā)展的基本法,國家必須給予適時修訂與完善,且保障其明顯的前瞻性和導(dǎo)向性。同樣,建立現(xiàn)代大學(xué)制度與建設(shè)世界一流大學(xué),必須要有相適應(yīng)的專門的大學(xué)法。
[Abstract]:The University of law, taking the University as the standard, is the basic law of university education, which plays a guiding role for the development of university education, reflects the principles and the basic spirit of the development of university education. In the case of Republic of Zambia, since the first university, attaches great importance to legal system construction of the University. In nearly half a century after independence. It is constantly revised in a timely manner, to grasp the time required. On the amendment of the University Act and college education, has long been one of the most urgent task in the development process of Zambia university education. The university research value in Republic of Zambia based on torture, University Law as the research object, the use of text analysis. The method of historical analysis and comparative analysis method on the course and content change was summarized and analyzed. On the whole, the research of the change of the University act from the perspective of a comprehensive understanding of Republic of Zambia University Law On the basis of the course of the change and the reform and development of the University, we hope to provide some inspiration for the construction of the legal system in our country.
Besides the introduction, is divided into four parts. The first part is the research on the legal system and education in colonial Zambia. It introduces the developing situation of legal system and education in the state of Zambia in the colonial period, analysis of the impact of local legal system and colonial background of the period of the Zambia Education backwardness the second part is the national independence. At the end of the 1980s Republic of Zambia university law research. Based on a brief review of the first Zambia Republic and the two Republic university law and revised on the basis of further discusses the changing process of the establishment of University macro management system and the history of the University. The third part is the study of Republic of Zambia University Law since 1990s. The fourth part is the summary and reflection of this study. Based on the history of science method in the comprehensive analysis, summed up the general characteristics of Republic of Zambia the University of law, the future direction of content change and revision principles of University Law and its changes. At the end of the research on China's "Higher Education Law > was thinking, from two aspects of legislation and law enforcement to reflect China's" higher education law ", proposed consummates our country higher education act.
The main conclusions are: the inherent significance of university education needs and the development of education in 1. universities has decided the necessary university law. Although the university law can not completely solve the problem of university to achieve social goals, however, on the basis of university policy decisions to guide the development of the University of Republic of Zambia is.2. the University method is very necessary is the most obvious feature of frequent amendment according to the situation, trend towards revision of the University's internal governance structure from the top-level design of university management system standard, for the healthy development of independent university formed under the law protection of the objective environment, but its role to the stability of the whole society to guarantee.3. as the higher education law of China's Higher Education Basic Law ", should be an important law to regulate and protect our higher education activities. To make our country high" The education law > become a truly leading the reform and development of higher education in the basic law, the state must be timely revised and perfected, and ensure its obvious forward-looking and guidance. Also, the establishment of modern university system and the construction of the world first-class university, must adapt to the university law specifically.
