【摘要】：在列國并立與競爭的時代,地緣政治與國際秩序的因素在很大程度上影響著一個國家內(nèi)部法律制度的演變。從近代以來國際秩序的演變來看,"超前立法"是弱國的立法者常見的行為。中國自晚清以來的"超前立法"源于兩種不同類型的國際行動策略選擇,第一種是適應(yīng)列強(qiáng)主導(dǎo)的國際霸權(quán)秩序,第二種是與列強(qiáng)主導(dǎo)的舊國際秩序決裂、并試圖創(chuàng)新國際秩序。基于第二種戰(zhàn)略選擇所奠定的基礎(chǔ),中國在新時代的適應(yīng)型戰(zhàn)略(以加入WTO為代表)大大增強(qiáng)了中國的硬實(shí)力,為中國分享國際規(guī)則制定權(quán)準(zhǔn)備了必要條件,并在思想上促進(jìn)對列強(qiáng)"普世文明論"的祛魅,也減少了"超前立法"的必要性。在新的歷史條件下,中國的法學(xué)理論研究有必要批判性地審視國際體系的演變與各國國際戰(zhàn)略選擇對其國內(nèi)法律制度的影響,將對本土法治經(jīng)驗(yàn)的總結(jié)與中國行使國際規(guī)則制定權(quán)的實(shí)踐結(jié)合起來。
[Abstract]:At a time when nations stand side by side with competition, The factors of geopolitics and international order greatly affect the evolution of a country's internal legal system. From the evolution of the international order since modern times, "leading legislation" is a common behavior of legislators in weak countries. The "advanced legislation" since the late Qing Dynasty originated from the choice of two different types of international action strategies. The first is to adapt to the international hegemonic order dominated by the powers, the second is to break with the old international order dominated by the powers, and to try to innovate the international order. China's adaptive strategy in the new era (represented by China's entry into WTO) has greatly strengthened China's hard power, prepared the necessary conditions for China to share the right to international rulemaking, and ideologically promoted the disenchantment of the "universal civilization theory" of the great powers. Under the new historical conditions, it is necessary to critically examine the evolution of the international system and the influence of various countries' international strategic choices on their domestic legal systems under the new historical conditions. This paper combines the experience of local rule of law with China's practice of exercising the right to make international rules.
