【摘要】：我國(guó)已步入社會(huì)轉(zhuǎn)型期的道德滑坡問題令人反思。當(dāng)下，社會(huì)發(fā)生的小悅悅事件和彭宇扶人被訛等不正�，F(xiàn)象，顛覆了傳統(tǒng)美德和良善人性，體現(xiàn)了市場(chǎng)經(jīng)濟(jì)條件下的金錢至上、明哲保身、麻木不仁、實(shí)用主義、逐利主義等觀念的盛行，引發(fā)了全社會(huì)對(duì)社會(huì)轉(zhuǎn)型期道德嚴(yán)重滑坡的高度關(guān)注和深刻反思。通過對(duì)小悅悅事件引發(fā)的道德滑坡與否的爭(zhēng)鳴、法律是否應(yīng)介入道德問題之論爭(zhēng)和彭宇案中有關(guān)爭(zhēng)議焦點(diǎn)的評(píng)析，以及對(duì)社會(huì)道德問題的結(jié)構(gòu)分析和法律介入道德的現(xiàn)實(shí)迫切需要的論述，展示了我國(guó)改革開放以來(lái)社會(huì)道德滑坡的現(xiàn)實(shí)狀況，促發(fā)了如何在反思中遏止道德滑坡的社會(huì)思考。道德滑坡問題曾在各國(guó)都有不同程度的存在，然而這些國(guó)家通過各種制度措施，包括用法律制裁某些缺德、敗德行為，，道德滑坡問題在很大程度上得到遏止。我國(guó)道德滑坡嚴(yán)重特別是見危不救現(xiàn)象，是對(duì)生命或者社會(huì)公共利益的漠視，而對(duì)這種具有嚴(yán)重社會(huì)危害性的行為，我國(guó)缺乏明確的可以利用的法律規(guī)范來(lái)進(jìn)行調(diào)整和規(guī)制。推動(dòng)某些與公共道德密切相關(guān)問題的法律化、用法律制裁某些不道德行為，是必要和可行的。遏止道德滑坡，從道德重建的觀念轉(zhuǎn)型著力，同時(shí)用剛性立法推進(jìn)道德重建。凝聚道德重建的社會(huì)共識(shí)，用社會(huì)正義引領(lǐng)社會(huì)良善，從危機(jī)中重建信任，從而推進(jìn)道德重建的觀念轉(zhuǎn)型；通過推行德行補(bǔ)償、懲罰訛詐救助的行為、照顧義務(wù)的法定義務(wù)化、力促好人免責(zé)、借鑒國(guó)外經(jīng)驗(yàn)推動(dòng)見危不救入罪等手段，建立健全我國(guó)某些領(lǐng)域道德重建的法律制度建設(shè)。
[Abstract]:The moral decline in China, which has entered a period of social transformation, is a cause for reflection. At present, abnormal phenomena such as the Xiao Yue Yue incident and the false experience of Peng Yufu have subverted traditional virtues and good human nature. Embodied in the market economy under the conditions of money supremacy, clear philosophy, insensitive, pragmatism, profit-oriented and other concepts of prevalence, It has caused the whole society to pay close attention to and deeply reflect on the serious moral decline in the period of social transformation. Through the controversy over whether or not the moral slide caused by the Xiaoyue Yue incident, Whether the law should be involved in the debate of moral issues and the comments on the focus of the controversy in Peng Yu's case, as well as the analysis of the structure of social moral issues and the exigencies of the reality of legal intervention in morality, It shows the reality of the social moral decline since the reform and opening up in our country, and promotes the social thinking on how to stop the moral landslide in the reflection. However, these countries have adopted various institutional measures, including the use of laws to punish certain acts of moral immorality and moral failure, and the problem of moral landslide has been largely curbed. The moral landslide in our country is serious, especially the phenomenon of failure to save in danger. It is a disregard for life or the public interest of the society, but to this kind of behavior which has serious social harmfulness, It is necessary and feasible to promote the legalization of some issues closely related to public morality, and to punish certain immoral behaviors by law. From the concept of moral reconstruction transformation, at the same time using rigid legislation to promote moral reconstruction, to consolidate the social consensus of moral reconstruction, to use social justice to lead the social good, to rebuild trust from the crisis, so as to promote the transformation of the concept of moral reconstruction; By means of promoting moral compensation, punishing the act of blackmail and rescuing, taking care of the legal obligation of duty, promoting the exemption of good people, and drawing lessons from foreign experience to promote the construction of legal system of moral reconstruction in some fields of our country, we can learn from the experience of foreign countries and promote the construction of legal system of moral reconstruction in some fields of our country.
