【摘要】：隨著我國“社會(huì)主義法治國家”目標(biāo)的確立,依法治國,建設(shè)法治國家提上日程。法治國家的建設(shè)離不開法治文化的培育,隨著法治國家建設(shè)的深入,法治文化的研究受到了越來越多國內(nèi)學(xué)者的關(guān)注,而且也受到高層領(lǐng)導(dǎo)機(jī)關(guān)的高度重視。法治文化的建設(shè)成為當(dāng)前研究的一個(gè)重要課題。當(dāng)前對法律文化的研究已為廣大學(xué)者所熟知,但單獨(dú)對法治文化尤其是當(dāng)代中國法治文化如何進(jìn)行理論構(gòu)建的學(xué)術(shù)性著作并不多。法治國家的建設(shè)離不開理論的指導(dǎo),在我國這樣一個(gè)缺乏法治傳統(tǒng)的國家進(jìn)行這樣一個(gè)偉大的工程更是如此,從實(shí)際出發(fā),合理吸收西方法治實(shí)踐中的有力因素,總結(jié)實(shí)踐中的經(jīng)驗(yàn)教訓(xùn)得出理論,再用理論指導(dǎo)實(shí)踐,達(dá)到建設(shè)法治國家的目的將是我國法治建設(shè)的基本路徑。本文意在探求法治文化蘊(yùn)涵的基本價(jià)值觀,闡釋法治文化所追求的人自身解放的目的,得出了法治國家是社會(huì)發(fā)展進(jìn)程中較理性的治國方略,同時(shí)運(yùn)用法學(xué)理論,法社會(huì)學(xué)的視角界定法治文化的概念,分析法治在西方的發(fā)展歷程及在中國缺失的原因,重點(diǎn)論證法治文化對社會(huì)主義法治國家建設(shè)的深刻影響,分析中國實(shí)現(xiàn)法治國家建設(shè)背后所要解決的本質(zhì)問題,并針對問題提出解決的路徑,通過學(xué)習(xí)借鑒西方先進(jìn)的法治文化,從我國的國情出發(fā),探索出一條適合我國國情的法治文化建設(shè)之路,實(shí)現(xiàn)建設(shè)法治國家,建設(shè)和諧的法治社會(huì)的目的。 本文除引言和結(jié)束語外共分四部分。第一部分,闡述了法治文化的涵義,通過解讀法治所蘊(yùn)含的價(jià)值,總結(jié)出法治文化建設(shè)對國家建設(shè)的重要意義。第二部分,從古希臘的法治思想談起,介紹了西方法治文化的發(fā)展歷程,通過比較中西法治文化的不同,總結(jié)出不同法治文化的深層次的原因。第三部分開始介紹我國對法治國家建設(shè)的探索歷程。從清末開始的探索一直持續(xù)到當(dāng)代,中間取得了寶貴的經(jīng)驗(yàn),更多的是沉痛的教訓(xùn)。第四部分,從顯性和隱形兩個(gè)方面論述了中國建設(shè)法治國家所要采取的路徑。提出要從兩個(gè)方面全面構(gòu)建科學(xué)的法治文化。
[Abstract]:With the establishment of the goal of "socialist country ruled by law", the rule of law and the construction of a country ruled by law are on the agenda. The construction of a country ruled by law cannot be separated from the cultivation of the culture of the rule of law. More and more domestic scholars pay attention to the study of the culture of rule of law. The construction of a culture of the rule of law has become an important subject of current research. The current research on legal culture has been well known to the majority of scholars. However, there are few academic works on how to construct the theory of the culture of rule of law, especially in contemporary China. The construction of a country ruled by law can not be separated from the guidance of theory. This is especially true of such a great project in a country like China, which lacks the tradition of the rule of law. Proceeding from the reality, we can reasonably absorb the powerful factors in the practice of the rule of law in the west, sum up the experience and lessons in the practice, and draw up the theory. To guide practice with theory, to achieve the goal of building a country ruled by law will be the basic path of the construction of the rule of law in China. This paper aims to explore the basic values contained in the culture of rule of law, and to explain the purpose of emancipation of people pursued by the culture of rule of law. It is concluded that a country ruled by law is a rational strategy of governing the country in the process of social development. At the same time, the concept of culture of rule of law is defined from the perspective of law theory and sociology of law, and the development course of rule of law in the West and the reasons for the absence of rule of law in China are analyzed. This paper focuses on the profound influence of the culture of rule of law on the construction of a socialist country ruled by law, analyzes the essential problems to be solved behind the construction of a country ruled by law in China, and puts forward the path to solve the problem. By learning from the advanced culture of the rule of law in the west and proceeding from the national conditions of our country, this paper explores a way for the construction of the culture of rule of law, which is suitable for the national conditions of our country, in order to realize the goal of building a country ruled by law and building a harmonious society by law. This paper is divided into four parts in addition to the introduction and conclusion. The first part expounds the meaning of the culture of the rule of law, through the interpretation of the value of the rule of law, summarizes the importance of the construction of the culture of the rule of law to the construction of the country. Starting from the thought of rule of law in ancient Greece, this paper introduces the development course of the culture of rule of law in the west, and compares the differences of the culture of rule of law between China and the West. The third part begins to introduce the course of our country's exploration on the construction of a country ruled by law. The exploration from the end of Qing Dynasty to the present age has been continued, and valuable experience has been gained in the middle. Part 4th discusses the path that China should take in building a country ruled by law from the aspects of dominance and invisibility, and puts forward the idea of constructing a scientific culture of rule of law from two aspects.
