【摘要】：作為法治的基本原則,法的一般性既體現(xiàn)法律規(guī)范的特征,又彰示法治實(shí)現(xiàn)的進(jìn)路。相對(duì)于西方國(guó)家借助法的一般性走向形式法治,進(jìn)而提出對(duì)法治思維和法律方法的倡導(dǎo),在中國(guó),具有辯證特質(zhì)的實(shí)質(zhì)思維卻消解了法的一般性。而法治中國(guó)目標(biāo)的實(shí)現(xiàn),還必須在形式法治理念下進(jìn)行建構(gòu)。此時(shí)法的一般性就不再只是純粹的立法"宣示",還具有解釋和應(yīng)用上的意義。體現(xiàn)在當(dāng)前的法治建設(shè),合理選擇立法對(duì)策的著力點(diǎn)、正確認(rèn)識(shí)特色國(guó)情中的權(quán)力思維模式、強(qiáng)化規(guī)則意識(shí)下的法治思維活動(dòng)都是法的一般性原則回溯,也進(jìn)而構(gòu)成法治中國(guó)目標(biāo)實(shí)現(xiàn)的必然要求。
[Abstract]:As the basic principle of the rule of law, the generality of law not only embodies the characteristics of legal norms, but also shows the way to realize the rule of law. In China, the dialectical essence of thinking dispels the generality of law, and the realization of the goal of ruling by law in China, At this time, the generality of the law is no longer merely a mere declaration of legislation, but also of interpretation and application. It is embodied in the current construction of the rule of law and the rational choice of legislative countermeasures. The correct understanding of the thinking mode of power in the characteristic national conditions and the strengthening of the thinking activity of the rule of law under the consciousness of the rule of law are all retrospect of the general principles of law, and then constitute the inevitable requirements for the realization of the goal of the rule of law in China.
