【摘要】：中、俄兩國(guó)不同的法律文化孕育著不同的法律制度，這是研究和比較各國(guó)繼承法的基礎(chǔ)和前提條件。新修訂的俄羅斯聯(lián)邦繼承法既有它繼受神圣羅馬帝國(guó)的歷史傳統(tǒng)一面，又有它接受?chē)?guó)際共同生活準(zhǔn)則的現(xiàn)代化一面，我國(guó)需要從一個(gè)大國(guó)的法律制度如何擯棄僵死的內(nèi)核以及吸收現(xiàn)代理念中學(xué)習(xí)到有益的東西,為借鑒俄羅斯繼承法相關(guān)立法的經(jīng)驗(yàn)，本文采用比較分析和多種學(xué)科相互滲透的交叉研究的方法，從介紹中俄繼承法律制度立法狀況入手，客觀(guān)的比較了我國(guó)與俄羅斯繼承法律制度之間的差異性，我國(guó)現(xiàn)行繼承立法部分內(nèi)容還存有不甚科學(xué)、合理之處，故本論文對(duì)法定繼承、遺囑繼承、遺產(chǎn)的處理等都進(jìn)行了深入的分析，在認(rèn)真吸收和充分利用已有研究成果的基礎(chǔ)上，將繼承制度放在特定的法律制度文化背景下，對(duì)是否引進(jìn)繼承相關(guān)制度進(jìn)行了新的思考，，并通過(guò)中俄繼承制度的比較研究，為我國(guó)繼承法的修訂提供理論依據(jù)。
[Abstract]:In Russia, the legal culture of different breeds of different laws and regulations, it is the foundation and prerequisite to research and compare the inheritance law of every country. The new revision of the law of inheritance in Russian Federation is it following the Holy Rome Empire history side, it had to accept the international living standards of modern side, China needs to to learn something useful to abandon the dead kernel from the legal system of a country and absorb modern ideas, for reference of Russian inheritance law related legislation experience, method of comparative analysis and interdisciplinary research in various disciplines of mutual penetration in this paper, starting from the introduction of Russian legal system of inheritance legislation, objective comparison China and Russia inherited the legal system, the legislative part of our present inheritance are still not very scientific, reasonable, so this paper on the legal inheritance,. Have inheritance, heritage processing are analyzed in detail, based on careful absorption and utilization of the existing research results, the inheritance system in the specific legal system and cultural background, to inherit the relevant system whether the introduction of new thinking, and through the comparative study of Sino Russian succession system, and provide a theoretical basis for the for the revision of the law of succession in China.
