中國古代教令權(quán)制度研究

【摘要】:教令權(quán)是中國古代傳統(tǒng)孝道與倫理的重要體現(xiàn),在中國源遠流長、根深葉茂。封建社會末期舊的法律體系徹底瓦解,教令權(quán)也消失在法律制度之中。但是教令權(quán)制度在中國古代社會漫長的歷史時期中存續(xù),并且其作用不可小覷,必然有其自身的優(yōu)勢。將中國法律的傳統(tǒng)因素作為知識來源古為今用,對于法律體系的完善,與解決中國社會現(xiàn)實問題,都有極大的助益。對于傳統(tǒng)禮教與法律的研究,由于其本身具備較強的理論性和現(xiàn)實性,一直為學界關(guān)注和探討,但對于教令權(quán)的研究卻是鳳毛麟角。本文主要劃分為四個部分,從不同方面探析中國古代教令權(quán)制度。首先,以時間為線索,闡述教令權(quán)不同階段的發(fā)展變化,從先秦時期在宗法社會萌芽,到漢代時期依托儒家思想開始形成,東晉時期為法律所收錄,到北齊開始將不孝罪與違犯教令罪區(qū)別開來,至唐代發(fā)展成熟,唐代之后明清大體承襲唐律規(guī)定,隨著封建社會的發(fā)展階段由盛轉(zhuǎn)衰教令權(quán)也不斷被強化。其次,從小農(nóng)經(jīng)濟、家國同構(gòu)的政治結(jié)構(gòu)、儒家文化三個方面分析教令權(quán)產(chǎn)生的原因。繼而將教令權(quán)從家長權(quán)、父權(quán)的廣泛內(nèi)容中抽離出來,明確教令權(quán)的內(nèi)涵,具體分析教令權(quán)所包含的懲戒、送懲等方面的內(nèi)容,以及體現(xiàn)出的特點。最后,分析中國古代教令權(quán)制度的作用,對于教令權(quán)制度的優(yōu)劣進行評析,以期得到對于現(xiàn)代社會所面臨的社會問題的一些啟示。
[Abstract]:As an important embodiment of the traditional filial piety and ethics in ancient China, the power of the teachings has a long history in China, and the old legal system in the end of feudal society completely disintegrated. The right of teaching order also disappeared in the legal system, but the system of the right of instruction survived in the long historical period of Chinese ancient society, and its function can not be underestimated. Taking the traditional factors of Chinese law as a source of knowledge for the present is of great help to the perfection of the legal system and to the solution of the practical problems of Chinese society. Because of its strong theory and reality, it has always been concerned and discussed by the academic circles, but the research on the right of the teaching order is rare. This paper is divided into four parts, and analyzes the system of the right of the ancient Chinese teaching from different aspects. Taking time as the clue, this paper expounds the development and changes of the different stages of the right of teaching and order, from the germinating of patriarchal society in the pre-Qin period to the beginning of the formation of Confucianism in the Han Dynasty, and the legal collection of the Eastern Jin Dynasty. By the beginning of the Northern Qi Dynasty, the crime of unfilial piety was distinguished from the crime of violating the religious orders. After the Tang Dynasty, the Ming and Qing dynasties generally inherited the laws of the Tang Dynasty. As the feudal society developed from prosperity to decline, the power of religious orders was constantly strengthened. Secondly, from the small-scale peasant economy, The political structure of isomorphism of the family and the Confucian culture analyzes the causes of the power of the teaching order. Then, it separates the right of the teaching order from the extensive contents of the parental right and the patriarchal right, clarifies the connotation of the power of the teaching order, and analyzes concretely the discipline contained in the right of the teaching order. Finally, this paper analyzes the function of the system of the right of teaching order in ancient China, and evaluates the merits and demerits of the system in order to get some enlightenment to the social problems faced by the modern society.
