【摘要】：漢律制定了比較詳細(xì)的盜竊犯罪構(gòu)成認(rèn)定標(biāo)準(zhǔn),確立了以贓入罪的盜竊犯罪懲處原則,出臺(tái)了寬嚴(yán)相濟(jì)、區(qū)別對(duì)待的具體司法執(zhí)行措施,并通過(guò)比較嚴(yán)苛的盜竊犯罪防范制度,構(gòu)建出了一個(gè)較為完整的漢代盜竊罪的法律規(guī)制體系。
[Abstract]:Han Law formulated more detailed standards for the determination of the constitution of the theft crime, established the principle of punishment for the crime of theft committed by stolen goods, introduced specific judicial enforcement measures of combining leniency with severity and discriminating treatment, and adopted a more stringent system of prevention of theft crimes. A relatively complete system of legal regulation of theft in the Han Dynasty was constructed.
