【摘要】：近年來,利用"偽基站"截取、冒用手機(jī)號(hào)碼,竊取手機(jī)卡信息,強(qiáng)行向不特定群體發(fā)送短信,大肆實(shí)施電信詐騙和非法廣告推銷等違法犯罪活動(dòng)屢屢發(fā)生,嚴(yán)重危害到通信安全和社會(huì)穩(wěn)定,成為司法機(jī)關(guān)的重點(diǎn)打擊對(duì)象。實(shí)踐中,圍繞傳授"偽基站"操作技術(shù)、使用"偽基站"是否危害公共安全等問題的認(rèn)定存在爭(zhēng)議。鑒于此,本刊與廣西壯族自治區(qū)柳州市人民檢察院遴選典型案例,共同邀請(qǐng)有關(guān)專家,對(duì)司法實(shí)踐中辦理非法使用"偽基站"案件爭(zhēng)議問題進(jìn)行深入研討。
[Abstract]:In recent years, the use of "pseudo-base stations" to intercept, falsely use mobile phone numbers, steal mobile phone card information, forcibly send short messages to non-specific groups, and wantonly carry out illegal and criminal activities such as telecom fraud and illegal advertising and promotion have occurred frequently. Seriously endangering the security of communications and social stability, and becoming a key target of attack by judicial organs. In practice, there is a dispute over whether the use of "pseudo-base stations" or imparting "pseudo-base station" operation technology is harmful to public safety, etc. In view of this, The Journal and the Liuzhou people's Procuratorate of Guangxi Zhuang Autonomous region selected typical cases and invited experts to conduct in-depth discussions on the dispute over the illegal use of "pseudo-base stations" in judicial practice.
