【摘要】：綠色法治是我國(guó)為解決嚴(yán)峻的生態(tài)危機(jī)、實(shí)現(xiàn)法治本身的現(xiàn)代化轉(zhuǎn)型以及對(duì)生態(tài)法治的揚(yáng)棄而提出的概念。所謂綠色法治,就是以天人合一的生態(tài)理性為哲學(xué)基礎(chǔ),以人與自然和諧共生的良法理念為價(jià)值取向,以法治綠色化的整體主義為思維方式,以綠色法治化的合作治理為行為模式,以低碳節(jié)約的消費(fèi)方式為生活態(tài)度的理念系統(tǒng)和綠化過(guò)程。它是綠色理念系統(tǒng)、綠色制度系統(tǒng)與綠色行為系統(tǒng)的有機(jī)統(tǒng)一,是理念、制度和行為的天然融合。綠色法治的基本內(nèi)容和行為要求包括:法律規(guī)范科學(xué)化是綠色法治的制度支撐;執(zhí)紀(jì)執(zhí)法法治化是綠色法治的行為要求;司法裁判公正化是綠色法治的最后屏障;守法信法大眾化是綠色法治的群眾基礎(chǔ)。
[Abstract]:Green rule of law is a concept put forward by our country in order to solve the severe ecological crisis, realize the modernization transformation of the rule of law itself and sublate the ecological rule of law. The so-called green rule of law is based on the ecological rationality of the unity of nature and man. It takes the idea of harmonious coexistence between man and nature as the value orientation, the whole doctrine of the rule of law as the thinking mode, and the cooperative governance of the green rule of law as the behavior mode. A concept system and a greening process based on a low carbon saving consumption style. It is a green concept system, an organic unity of the green system and a green behavior system, and an idea. The basic contents and behavior requirements of the green rule of law include: the scientific legal norm is the institutional support of the green rule of law, the rule of law by law enforcement is the behavior requirement of the green rule of law; Judicial justice is the final barrier of green rule of law, and the popularization of law abiding by law is the mass basis of green rule of law.
