【摘要】：在"安人寧國"的治國方針的引導(dǎo)下,唐代的統(tǒng)治者集前朝之所長,制造了詳盡規(guī)范的律法。其中,《唐律疏議》作為我國最早、最完整的一部法典,是唐代法律之代表,不僅對中國后世法律影響深遠(yuǎn),而且使得東南亞等國家效仿我國法律的藍(lán)本。因此,本文對《唐律疏議》中有關(guān)職務(wù)犯罪的規(guī)定進(jìn)行了概述,并且從中分析其利弊,使得在當(dāng)下我們制定刑法修正案時,能夠?qū)Α短坡墒枳h》中關(guān)于職務(wù)犯罪取其精華,去其糟粕,完善現(xiàn)代之律法。
[Abstract]:Under the guidance of the policy of governing the country in peace with the people, the rulers of the Tang Dynasty gathered their advantages and made detailed and standardized laws. Among them, the Tang Law, as the earliest and most complete code of law in China, was the representative of the laws of the Tang Dynasty. It not only has a profound influence on the law of later generations of China, but also makes Southeast Asia and other countries emulate the original version of Chinese law. Therefore, this paper summarizes the provisions of duty crime in Tang Law, and analyzes its advantages and disadvantages. So that when we make the amendment of criminal law at present, we can select the essence of duty crime in Tang Ruoshou, discard its dross and perfect the modern law.
