【摘要】：在美國,傳統(tǒng)的以最佳可得技術(shù)為核心的命令控制型環(huán)境規(guī)制模式逐漸暴露出局限性與弊端,以經(jīng)濟激勵和市場機制補充甚至取代命令控制模式的環(huán)境法改革方案層出不窮。本文以泡泡政策和謝弗林案為楔子,探討作為排污權(quán)交易概念雛形的"泡泡"如何變通甚至規(guī)避了《清潔空氣法》規(guī)定的新污染源審查機制,比較命令控制和經(jīng)濟激勵兩種規(guī)制模式的優(yōu)劣,并在此基礎(chǔ)上論證建立綜合性規(guī)制體系的必要性、可行性,以及優(yōu)化規(guī)制組合的具體改革路徑。美國環(huán)境規(guī)制演變的歷史進程可以為我國空氣治理的完善提供有益借鑒。
[Abstract]:In the United States, the traditional command-controlled environmental regulation model with the best available technology as the core has gradually exposed its limitations and drawbacks. Environmental law reform programs that supplement or even replace the command control model with economic incentives and market mechanisms emerge in endlessly. This paper takes bubble policy and the case of Schaefflin as the wedges. This paper discusses how the "bubble", which is the embryonic concept of emission trading, adapts or evades the new pollution source review mechanism stipulated in the Clean Air Law, and compares the advantages and disadvantages of the two regulatory modes: command control and economic incentive. On this basis, the necessity and feasibility of establishing a comprehensive regulatory system, as well as the specific reform path of optimizing the regulatory combination, are demonstrated. The historical process of the evolution of environmental regulation in the United States can provide a useful reference for the improvement of air governance in China.
