【摘要】：模糊性,作為語言內(nèi)在本質(zhì)的特征,它在法律語言中也是普遍存在的現(xiàn)象。通過對(duì)法律文獻(xiàn)中模糊現(xiàn)象的分析表明說話者或法律文獻(xiàn)的起草者在法庭上或法律文獻(xiàn)中有意使用模糊語以達(dá)到交際靈活性的目的。而在中國(guó),對(duì)于模糊語言的研究相比其他語言學(xué)科起步相對(duì)較晚。本文作者由此想到如何將模糊語與法律語言相結(jié)合來進(jìn)行研究,從而使讀者對(duì)法律中的模糊語有更深入的認(rèn)識(shí)。 法律規(guī)范是國(guó)家意志的表現(xiàn),也是社會(huì)安定的重要保障。法律語言一直被認(rèn)為是最嚴(yán)謹(jǐn)?shù)恼Z用使用形式,沒有嚴(yán)謹(jǐn)性和準(zhǔn)確性,法律就失去了它應(yīng)有的強(qiáng)制性和權(quán)威性。然而法律語言作為語言的一個(gè)特殊分支,不可避免的也兼具模糊性的特征。正是這種模糊性的特征使得法律在執(zhí)行的過程中更具有應(yīng)用的靈活性。本文作者通過對(duì)法律語言中的模糊語現(xiàn)象及其成因的研究從而可以更深入的了解模糊語在法律語言中的應(yīng)用。 為了更好的掌握模糊語與法律文獻(xiàn)之間的關(guān)系,本文作者首先從介紹模糊語的背景知識(shí)入手,對(duì)一些相關(guān)的基本概念給予合理的解釋說明。隨后進(jìn)入本論文的主要部分,探討法律語言中模糊語的形式及成因,以及模糊現(xiàn)象如何輔助法律語言在應(yīng)用中得以更加精準(zhǔn)到位,以期運(yùn)用語言學(xué)知識(shí)來解決法律活動(dòng)中模糊語言的正確使用問題,最終實(shí)現(xiàn)法律語言的準(zhǔn)確性,促進(jìn)法律的發(fā)展和完備,這是本文研究的目的和意義所在。
[Abstract]:Fuzziness, as the intrinsic essence of language, It is also a common phenomenon in the legal language. The analysis of vagueness in the legal literature shows that the speaker or the drafter of the legal document intentionally uses vague language in court or in the legal document in order to achieve communication agility. The purpose of sex. And in China, The study of fuzzy language is relatively late compared with other language subjects. The author of this paper thinks of how to combine fuzzy language with legal language so that readers can have a deeper understanding of vague language in law. Legal norms are an expression of the will of the state and an important guarantee of social stability. Legal language has always been regarded as the most rigorous form of pragmatic use without rigour and accuracy. The law loses the compulsion and authority it deserves. However, the legal language is a special branch of the language. It is this feature of fuzziness that makes the law more flexible in its application. The author studies the phenomenon of fuzziness in legal language and its causes. So we can understand the application of vague language in legal language. In order to better understand the relationship between vague language and legal literature, the author begins with the introduction of the background knowledge of vague language, and gives a reasonable explanation of some related basic concepts. Then he enters the main part of this paper. This paper probes into the forms and causes of vague language in legal language, and how fuzziness can assist the application of legal language in order to use linguistic knowledge to solve the problem of the correct use of vague language in legal activities. The purpose and significance of this paper is to achieve the accuracy of legal language and promote the development and perfection of law.
