【摘要】：要實現(xiàn)對先秦法家思想的批判性繼承和創(chuàng)造性轉(zhuǎn)化,有賴于對法家思想進(jìn)行一種歷史整體性的建構(gòu),描繪其歷史脈絡(luò)和觀念譜系。因此,有必要發(fā)掘和檢視以陳啟天為代表的民國"新法家"對于先秦法家思想的續(xù)造。民國"新法家理論"的主旨,就是以依憲治國為核心的民主政治理論。但民國"新法家理論"內(nèi)在的理論缺陷和矛盾,是其日漸式微的一個重要原因。當(dāng)下中國特色社會主義國家治理理論的建設(shè),應(yīng)當(dāng)注意到民國"新法家理論"具有的借鑒價值和反思性啟示。
[Abstract]:In order to realize the critical inheritance and creative transformation of the thought of Legalists in the Pre-Qin Dynasty, it is necessary to construct a kind of historical integrity to describe its historical context and concept pedigree. It is necessary to explore and examine the continuation of the ideas of the "New Legalists" of the Republic of China, represented by Chen Qitian. It is a democratic political theory with the core of governing the country according to the constitution. However, the inherent theoretical defects and contradictions in the "New Legalist Theory" of the Republic of China are an important reason for its gradual decline. At present, the construction of the theory of governance of socialist countries with Chinese characteristics, We should pay attention to the reference value and reflective enlightenment of the "New Legalist Theory" of the Republic of China.
