【摘要】：民間權(quán)力是社會(huì)權(quán)力的中國(guó)話語(yǔ)。民間權(quán)力是民間社會(huì)主體依靠掌控的社會(huì)資源通過(guò)"強(qiáng)制"與"教化"等方式對(duì)相對(duì)人形成的支配力和影響力。民間權(quán)力產(chǎn)生于"家國(guó)同構(gòu)"的傳統(tǒng)中國(guó)社會(huì),并因應(yīng)社會(huì)結(jié)構(gòu)的改變?cè)谥黧w、內(nèi)容、機(jī)制等方面不斷演化。民間權(quán)力包括主體、相對(duì)人、民間權(quán)力資源和運(yùn)行機(jī)制等構(gòu)成要素。民間權(quán)力具有秩序維護(hù)、規(guī)則創(chuàng)制、制度構(gòu)造以及民間司法等功能。法治面向的民間權(quán)力必須從自由與秩序的價(jià)值衡平出發(fā),確立獨(dú)立自主的主體地位,創(chuàng)生"法、理、情"的民間權(quán)力運(yùn)行機(jī)制。
[Abstract]:The folk power is the Chinese discourse of the social power. The folk power is the dominating force and influence formed by the subject of civil society on the relative person through the means of "compulsion" and "enlightenment". The folk power comes into being. In the traditional Chinese society of "homogeneity of family and country", In response to the changes in social structure, such as subject, content, mechanism and so on, the folk power includes the main body, the relative person, the folk power resources and the operating mechanism, etc. The folk power has the order maintenance, the rule creation, etc. The civil power oriented by the rule of law must proceed from the value balance of freedom and order, establish the independent subject status, and create the running mechanism of "law, reason and emotion".
