【摘要】：中國《老年人權(quán)益保障法》第二章"家庭贍養(yǎng)與撫養(yǎng)"規(guī)定家庭絕對的無限養(yǎng)老責任,符合儒家傳統(tǒng)孝道標準,但操作性不強,不符合現(xiàn)代法治精神,難以內(nèi)化成現(xiàn)代公民社會認同的"理";缺乏自我養(yǎng)老責任倡導(dǎo),家庭養(yǎng)老與自我養(yǎng)老未能整合;政府、家庭和個人間缺乏中間組織的有效聯(lián)結(jié),家庭養(yǎng)老缺乏外部監(jiān)督,多元養(yǎng)老主體的協(xié)調(diào)行動難以達成,"法"的踐行效果不好。而新加坡《贍養(yǎng)父母法》僅規(guī)定家庭承擔父母基本需求,強調(diào)權(quán)利與義務(wù)的平衡,操作性強,是一種法治而非孝治,體現(xiàn)了新加坡綜合文化而非儒家文化的核心價值觀;政府與家庭、民眾間的聯(lián)系暢通,有強化家庭養(yǎng)老和保障自我養(yǎng)老的激勵措施;自我養(yǎng)老觀念深入人心,多元主體養(yǎng)老行動具有協(xié)同性。
[Abstract]:Chapter II of China's Law on the Protection of the Rights and interests of the elderly, "Family support and upbringing," stipulates that the family is absolutely unlimited in providing for the aged, which conforms to the Confucian traditional standards of filial piety, but is not operative enough and does not conform to the spirit of modern rule of law. It is difficult to internalize into the "principle" recognized by modern civil society; lack of self-supporting responsibility advocacy, family pension and self-pension can not be integrated; the government, family and individual lack of effective links between intermediate organizations, family pension lack of external supervision, It is difficult to achieve the coordinated action of multiple subjects for the aged, and the practice of the "Law" is not good. However, Singapore's "Parental Care Act" only stipulates that families bear the basic needs of their parents, and emphasizes the balance between rights and obligations. It is a kind of rule of law, not filial piety, which is a kind of rule of law and not filial piety. It embodies the core values of Singapore's comprehensive culture, not the Confucian culture; the unimpeded connection between the government and the family, the people, and the incentive measures to strengthen the family pension and ensure the self-care; the concept of self-supporting is deeply rooted in the hearts of the people. The action of multiple subjects is synergistic.
