【摘要】：長期以來,我國法學教育存在的法學教育產(chǎn)出與法律實踐需求之間的矛盾一直未得到有效解決。究其原因,不是沒有頂層設計,而是頂層設計過多過亂;不是沒有探索,而是探索雜亂無序。在培養(yǎng)法科畢業(yè)生實踐能力的方法改革中,診所法律教育日漸顯示出勃勃生機與活力,正在逐步進入我國高等法學院校及科研機構(gòu)的法學教育體系,并向著入主流、規(guī)范化、國際化的方向發(fā)展,已經(jīng)形成中國特色的診所法律教育模式,并將圍繞形成中國理論、運用中國方法、解決中國問題的目標進一步發(fā)展完善。我們應在法學教育改革中全面推行中國特色診所法律教育。應該把診所法律教育作為法學教育的主流課程和必修課程,施教對象由法學本科生拓展至法科研究生,考核方法由軟性考核制轉(zhuǎn)化為強制考核制,承擔診所法律教育的師資隊伍也應由單一型師資向"雙師型"師資轉(zhuǎn)變。
[Abstract]:For a long time, the contradiction between the output of legal education and the demand of legal practice has not been effectively resolved. The reason is not that there is no top-level design, but that the top-level design is too much too much chaos, not that it has not been explored. In the course of the reform of the method of cultivating the practical ability of law graduates, the law education of clinic is showing vitality and vigor day by day, and it is gradually entering the legal education system of our country's higher law colleges and scientific research institutions. And toward the mainstream, standardization, internationalization direction, has formed the Chinese characteristics of the clinical legal education model, and will be around the formation of Chinese theory, the use of Chinese methods, The goal of solving the problems in China should be further developed and perfected. We should carry out the legal education of clinics with Chinese characteristics in a comprehensive way in the reform of law education. We should take clinical legal education as the mainstream and compulsory course of law education. The teaching object is extended from law undergraduate to law graduate student, the examination method is changed from soft examination system to compulsory examination system. The teaching staff who undertake the legal education of clinic should also change from a single type of teacher to a "double type" teacher.
