【摘要】：所謂貸款人環(huán)境責任是指貸款人在特定情形下要對借款人的設施或者容器釋放的危險廢棄物造成環(huán)境污染承擔責任。美國貸款人環(huán)境責任立法經(jīng)歷了幾次修改�！冻壔鸱ā芬�(guī)定了嚴格責任和連帶責任,責任主體非常寬泛,但存在模糊性。環(huán)境保護署規(guī)則澄清了《超級基金法》的模糊之處,但缺乏法律效力。1996年的《貸款人責任法》吸收了環(huán)境保護署規(guī)則的內(nèi)容,減輕了貸款人環(huán)境責任�！蹲氐卦偕ā窞橘J款人購買借款人財產(chǎn)提供了指引。盡管如此,貸款人環(huán)境責任風險依然存在。美國的貸款人環(huán)境責任立法對我國防治土壤污染具有啟示意義。
[Abstract]:The so-called environmental liability of the lender means that the lender is liable for environmental pollution caused by hazardous waste released by the borrower's facility or container under certain circumstances. The legislation on environmental liability of the United States lender has undergone several amendments. The Superfund Act provides for strict liability and joint and several liability. The EPA rules clarify the ambiguities of the Superfund Law, but lack of legal effect. The 1996 Law on lender liability absorbed the content of the EPA rules. This lessens the lender's environmental liability. The Palm Land Renewal Act provides guidance for lenders to buy borrower's property. The environmental liability risk of lenders still exists, and the legislation of environmental liability of lenders in the United States has enlightening significance for preventing and controlling soil pollution in China.
