【摘要】：1978年以來,中國(guó)逐步從"創(chuàng)法時(shí)代"邁向"修法時(shí)代"。1978—1993年,是中國(guó)改革啟動(dòng)及社會(huì)開始轉(zhuǎn)折的艱難階段,立法工作的重心放在對(duì)"政治屋頂"的修繕甚至重構(gòu)上。1993—1998年,立法理念總體上注重與改革發(fā)展的決策相結(jié)合,市場(chǎng)經(jīng)濟(jì)法治化初現(xiàn)端倪。1998—2008年,法律創(chuàng)制步伐放緩,法律修改力度加大,市場(chǎng)經(jīng)濟(jì)法治化全面鋪開。2008—2014年,立法進(jìn)入引領(lǐng)全面深化改革的新階段。梳理與總結(jié)1978—2014年改革進(jìn)程中法律修改的基本經(jīng)驗(yàn),分析立法工作重心逐步向法律修改轉(zhuǎn)移的特點(diǎn),有助于準(zhǔn)確理解全面推進(jìn)依法治國(guó)進(jìn)程中立法與改革關(guān)系的規(guī)律,更好地觀察和把握中國(guó)社會(huì)的發(fā)展軌跡和未來趨勢(shì)。
[Abstract]:Since 1978, China has gradually moved from the "creating law era" to the "law revision era" .1978-1993, which is a difficult stage when China's reform starts and the society begins to turn. The focus of the legislative work is on the renovation and even reconstruction of the "political roof" from 1993 to 1998. On the whole, the legislative concept is focused on combining with the decision-making of reform and development. From 1998 to 2008, the legal system of the market economy started to emerge. The pace of legal creation slowed down, the law amendment intensified, and the legal system of the market economy was comprehensively expanded from 2008 to 2014. Legislation has entered a new stage of leading the overall deepening of reform. The basic experience of law revision in the reform process from 1978 to 2014 is summarized, and the characteristics of the gradual shift from the focus of legislative work to the legal revision are analyzed. It is helpful to understand the law of the relationship between legislation and reform in the process of promoting the rule of law in an all-round way, and to better observe and grasp the development track and future trend of Chinese society.
