【摘要】：法學(xué)研究者對語言的關(guān)注是從上個世紀(jì)開始的，有關(guān)學(xué)者在他的研究中借用了語言哲學(xué)的理論，并根據(jù)這些構(gòu)建了一個自成體系的法律王國。語言的轉(zhuǎn)向給之后的法學(xué)研究者指向了一條新路徑——語言學(xué)的研究路徑。法學(xué)研究的開始是以語言為對象、研究語言和法律的關(guān)系、用語言學(xué)理論來分析法律活動，法律語言學(xué)由此產(chǎn)生了。我國對立法語言的研究是從20世紀(jì)70年代末80年代初開始的，大多數(shù)是以語言學(xué)的理論體系為框架，逐步構(gòu)建立法語言的體系。隨著研究的不斷深入，，語用學(xué)和語義學(xué)理論也越來越引起學(xué)者的關(guān)注，立法語言研究似乎在向著語用學(xué)和語義學(xué)的方向發(fā)展。從語用和語義的角度，根據(jù)維特根斯坦和奧斯汀的日常行為理論研究立法語言的準(zhǔn)確性與模糊性，雖然取得了一定的成果，如對立法語言確定性與模糊性的辯證認(rèn)識，對兩者相互作用的理解或?qū)δ：Z義詞語的肯定等等，但沒有從根本上解決立法語言失范的問題。 本文從立法漢語言的基本內(nèi)涵和外延入手，主要從立法語言的現(xiàn)狀問題進(jìn)行分析，分析立法語言的失范現(xiàn)象并對其進(jìn)行了總結(jié)，并且對外來語進(jìn)入我國立法語言的標(biāo)準(zhǔn)進(jìn)行初探，旨在探求建構(gòu)良法的語言路徑。本文以實證法從國家正式頒布的現(xiàn)行法規(guī)、報刊雜志的司法案例中選取了典型的材料，綜合運用語義分析、語法分析、語體分析和語用分析等方法概括出立法語言詞匯、句式和語體風(fēng)格特點，并就此展開對立法語言的規(guī)范化的討論。
[Abstract]:The attention paid by legal researchers to language began in the last century. In his research, some scholars borrowed the theory of linguistic philosophy. On the basis of these, a legal kingdom with its own system is constructed. The turn of language points to a new path to the study of linguistics. The beginning of the study of law is to take language as the object. The study of the relationship between language and law, and the analysis of legal activities by linguistic theory, have led to the emergence of legal linguistics. The study of legislative language in China began from the end of 1970s to the beginning of 80s. Most of them take the theoretical system of linguistics as the framework and construct the system of legislative language step by step. With the deepening of the research, pragmatics and semantics theory have attracted more and more attention of scholars. The research of legislative language seems to be developing towards the direction of pragmatics and semantics. From the perspective of pragmatics and semantics, the accuracy and fuzziness of legislative language are studied according to Wittgenstein and Austin's theory of daily behavior. Although some achievements have been made, such as the dialectical understanding of the certainty and fuzziness of legislative language, the understanding of their interaction or the affirmation of fuzzy semantic words and so on, it has not fundamentally solved the problem of legislative language anomie. This paper starts with the basic connotation and extension of Chinese legislative language, mainly analyzes the current situation of legislative language, analyzes the abnormal phenomenon of legislative language, and summarizes it. Furthermore, the paper probes into the standard of foreign language entering into the legislative language of our country, in order to explore the language path of constructing good law. This paper selects typical materials from the current laws and regulations officially promulgated by the state, the judicial cases of newspapers and magazines, and so on. The features of legislative language vocabulary, sentence structure and stylistic style are summarized by means of semantic analysis, grammatical analysis, stylistic analysis and stylistic analysis, and the standardization of legislative language is discussed.
