【摘要】：羅伯特·阿列克西是當(dāng)代德國(guó)著名法哲學(xué)大家，其代表著作《法律論證理論——作為法律證立理論的理性論辯理論》是法律論證理論的巔峰之作，，目前研究法律邏輯，特別是法律論辯都以該著作為一個(gè)必要的切入點(diǎn)。法律規(guī)范只有得到充分的論證，才能獲得人們的信服與認(rèn)可。因此，加強(qiáng)法律論證研究，具有重要的理論和現(xiàn)實(shí)意義。 在深入研究阿列克西理性論辯理論的基礎(chǔ)上，文章首先對(duì)阿氏理論的脈絡(luò)進(jìn)行了系統(tǒng)介紹，進(jìn)而完整地展示阿氏理論的重要內(nèi)容。其次，采用比較的方法對(duì)阿氏理論的成就與問(wèn)題進(jìn)行了分析，如“法律需要論證”觀念的確立、用“可接受性”取代“真實(shí)性”和作為“理論范式”的代表，這些成就是眾目共睹的，而論證的等級(jí)問(wèn)題、不能從形式證出內(nèi)容等問(wèn)題是阿氏理論的缺陷。最后，對(duì)建構(gòu)一種新的理性論辯理論進(jìn)行了探討。 在充分透徹地剖析了阿氏理論的基礎(chǔ)上，結(jié)合當(dāng)代孫斯坦未完全化法律論證理論和詮釋性法哲學(xué)帶來(lái)的啟發(fā)，文章提出一種新型的理性論辯理論，它是在阿氏理論框架內(nèi)的重建。在內(nèi)部證成方面，放棄一些模棱兩可的內(nèi)部證成規(guī)則，在進(jìn)行實(shí)踐性問(wèn)題的理論選擇或事實(shí)處理時(shí)，通過(guò)提升問(wèn)題的抽象程度或者降低問(wèn)題的抽象程度，用具體的實(shí)用情形追尋內(nèi)部證成的規(guī)則。在外部證成方面，用追求個(gè)案的平衡代替模糊的價(jià)值追尋，這樣就提升了法律論證理論的實(shí)踐性和可操作性。該研究不但透徹解析了阿列克西理性論辯理論的相關(guān)淵源與內(nèi)涵，而且在借鑒相關(guān)理論研究成果的基礎(chǔ)上豐富并嘗試解決理性論辯理論的難題，在法律論證理論研究中會(huì)起到一定的推動(dòng)作用。
[Abstract]:Robert Alexis is a famous contemporary German jurist, whose masterpiece, "the Theory of legal argumentation-the Theory of rational argumentation as the Theory of legal proof", is the pinnacle of the theory of legal argumentation, and now studies the logic of law. In particular, legal argumentation takes this work as a necessary starting point. Only if legal norms are fully demonstrated, can they be convinced and recognized. Therefore, it is of great theoretical and practical significance to strengthen the study of legal argumentation. Based on the in-depth study of Oleksiy's rational argument theory, this paper first introduces the context of Archer's theory systematically, and then presents the important content of Archer's theory completely. The achievements and problems of Archer's theory are analyzed by means of comparative methods, such as the establishment of the concept of "legal necessity demonstration", the substitution of "authenticity" with "acceptability" and the representation of "theoretical paradigm". However, the problem of hierarchy of argumentation, which can not be proved by form, is the defect of Archer's theory. Finally, the paper discusses the construction of a new theory of rational debate. On the basis of a thorough analysis of Archer's theory and the inspiration of modern Sun Stan's theory of incomplete legal argumentation and hermeneutic philosophy of law, this paper puts forward a new theory of rational argumentation. It is a reconstruction within the framework of Archer's theory. In the aspect of internal proof, we give up some ambiguous rules of internal proof, and in the course of theoretical choice or factual treatment of practical problems, By enhancing the abstract degree of the problem or reducing the abstract degree of the problem, the rules of internal proof are pursued with specific practical situations. In the aspect of external evidence, the pursuit of case balance is used instead of the fuzzy value pursuit. This has enhanced the practicability and operability of the theory of legal argumentation. This study not only thoroughly analyzes the origin and connotation of Oleksiy's theory of rational argumentation, And on the basis of using the relevant theoretical research results to enrich and try to solve the problem of rational argumentation theory, it will play a certain role in the legal argumentation theory research.
