【摘要】：網(wǎng)絡(luò)法律調(diào)整范圍的局限性、調(diào)控成本的昂貴性以及法律天然的滯后性,決定單純的法治無(wú)法實(shí)現(xiàn)網(wǎng)絡(luò)社會(huì)的有效治理。作為另一種調(diào)控網(wǎng)絡(luò)社會(huì)主體的行為準(zhǔn)則,道德觸角能作用于人們的靈魂,具有潛移默化的勸善功能,能夠促進(jìn)網(wǎng)絡(luò)良法體系的構(gòu)建、網(wǎng)絡(luò)公正執(zhí)法的實(shí)現(xiàn)以及網(wǎng)民守法習(xí)慣的養(yǎng)成。網(wǎng)絡(luò)社會(huì)治理的一條有效路徑是落實(shí)公眾參與網(wǎng)絡(luò)立法與執(zhí)法,提升執(zhí)法人員的職業(yè)道德,強(qiáng)化公民的道德教育與法制教育,實(shí)現(xiàn)網(wǎng)絡(luò)法治與德治的有效結(jié)合。
[Abstract]:The limitation of the scope of network legal adjustment, the high cost of regulation and control and the natural lag of law decide that the simple rule of law cannot realize the effective governance of the network society. The moral antennae can act on people's soul, have the function of persuading kindness imperceptibly, and can promote the construction of network good law system. An effective way to govern the network society is to implement the public participation in network legislation and law enforcement, to promote the professional ethics of law enforcement personnel, and to strengthen the moral education and legal education of citizens. To realize the effective combination of network rule by law and rule by virtue.
