【摘要】：盡管美國通過《武器出口管制法》等相關(guān)法律規(guī)制和懲處私營軍事安保公司(Private Military and Security Company,以下簡稱PMC)及其雇員的違法行為,但是美國有關(guān)PMC的法律制度存在較多漏洞,作用有限,這與美國PMC法律規(guī)制的發(fā)展受到諸多因素的制約有關(guān)。從美國法律規(guī)制的發(fā)展趨向來看:美國政府加強(qiáng)PMC法律規(guī)制是一個基本態(tài)度,但是這個過程是復(fù)雜而長期的;美國政府現(xiàn)在及未來一段時間主要將對國內(nèi)法的小修小補(bǔ)作為主要調(diào)整方式,而國際法對美國法律規(guī)制的影響作用將日益深入。對于中國來說,在推行"一帶一路"戰(zhàn)略的過程中,有越來越多的海外利益需要保護(hù)。我國應(yīng)該汲取美國的經(jīng)驗(yàn)和教訓(xùn),在完善相關(guān)法律、加強(qiáng)法律規(guī)制的基礎(chǔ)上,穩(wěn)步推進(jìn)我國私營安保公司的發(fā)展。
[Abstract]:Although the United States has passed the Arms Export Control Act and other relevant laws to regulate and punish the illegal behavior of private Military and Security company (PMC) and its employees, the United States' legal system on PMC has many loopholes and has a limited effect. This is related to the fact that the development of American PMC legal regulation is restricted by many factors. From the point of view of the development trend of American legal regulation, it is a basic attitude of the US government to strengthen the legal regulation of PMC, but the process is complex and long-term; At present and in the future, the US government will mainly make minor amendments to domestic laws as the main means of adjustment, while the impact of international law on American legal regulations will become increasingly profound. For China, In the course of carrying out the "Belt and Road" strategy, there are more and more overseas interests to be protected. China should learn from the experience and lessons of the United States, and on the basis of perfecting relevant laws and strengthening legal regulations, We will steadily promote the development of private security companies in our country.
