【摘要】：法治政府的建設(shè)已經(jīng)成為各級政府的一項(xiàng)重要議題,在此基礎(chǔ)上興起了一股法治地區(qū)建設(shè)的浪潮。量化法治的指標(biāo)與考評也成為法治地區(qū)建設(shè)工作中的一個(gè)重要環(huán)節(jié)。然而,法治指標(biāo)體系的差異化發(fā)展暴露了量化法治的諸多問題。對法治指標(biāo)體系的構(gòu)建展開法理思考,無疑是有重要意義的。 從國際和國內(nèi)兩個(gè)層面上介紹法治指數(shù)的實(shí)踐概況,為法治指標(biāo)體系的類型化分析奠定了必要的實(shí)證資料。通過法治指標(biāo)與法治要素之間的關(guān)聯(lián)性分析,將我們引到了對法治要素的梳理。在此基礎(chǔ)上檢視法治政府建設(shè)的指標(biāo)體系,為的是更加科學(xué)與合理的來審視法治指標(biāo)體系,以期能為今后法治指標(biāo)體系的構(gòu)建提供有益的實(shí)踐與理論指引,充分發(fā)揮法治指標(biāo)體系對法治政府建設(shè)的重要度量作用。 基本內(nèi)容如下： 第一部分主要介紹了量化法治的國際實(shí)踐及其經(jīng)驗(yàn),以及法治指標(biāo)體系的基本背景。 第二部分通過文獻(xiàn)實(shí)證研究,具體分析了量化法治在中國的實(shí)踐。在此基礎(chǔ)上,形成了我國法治指標(biāo)體系構(gòu)建的實(shí)踐先于理論的問題表述。 第三部分研究法治指標(biāo)體系構(gòu)建的理論基石,以便科學(xué)合理的評價(jià)法治指標(biāo)體系。因而,對法治及其基本要素的梳理成為不可或缺的理論部分。 第四部分基于以上分析,對我國量化法治實(shí)踐的檢視成為最為重要的一個(gè)部分。法治指標(biāo)體系的具體評價(jià)暴露了量化法治的諸多問題,但更為重要的是,這同時(shí)也指明了法治指標(biāo)體系構(gòu)建的基本方向。 全文的分析,形成了如下基本結(jié)論：首先,法治指標(biāo)體系的構(gòu)建,需要有效回應(yīng)法治基本要素,以獲得其應(yīng)有的合理性和可接受性。其次,法治指標(biāo)體系的構(gòu)建,應(yīng)當(dāng)著力解決政治至上的觀念障礙和公眾參與缺失的現(xiàn)實(shí)不足這兩大問題。最后,法治指標(biāo)體系需要在理論和實(shí)踐的共同參與下來完成,方能具備說服力和生命力。
[Abstract]:The construction of the government by law has become an important issue at all levels of government, based on the rise of a wave of legal construction area of the wave. Quantitative index and evaluation of the rule of law has become an important part of the construction of rule of law in the work area. However, differences in the development of the rule of law index system has exposed many problems to construct the quantization rule of law. The theory on the index system of the rule of law, is undoubtedly of great significance.
The practice of the rule of law index from two international and domestic level, provides the necessary empirical data for the type of analysis index system of the rule of law. The relationship between the rule of law and the rule of law index factor analysis, leads us to the rule of law. On the basis of combing the elements of the examination indexes system of the construction of the government under the rule of law. As is more scientific and reasonable to examine the index system of the rule of law, in order to provide theoretical and practical guidance for future construction of beneficial index system of the rule of law, give full play to the important role of the rule of law index system construction of government by law.
The basic contents are as follows:
The first part mainly introduces the international practice and experience of quantifying the rule of law, as well as the basic background of the index system of the rule of law.
The second part analyzes the practice of quantitative rule of law in China through the literature empirical research. On this basis, the practice of establishing the rule of law index system in China is formulated before theory.
The third part studies the theoretical cornerstone of the rule of law index system, so as to evaluate the rule of law index system scientifically and reasonably. Therefore, combing the rule of law and its essential elements is an indispensable part of theory.
The fourth part based on the above analysis, to examine the quantization rule of law practice has become the most important part. Many problems of the quantization rule of law specific evaluation index system of the rule of law, but more importantly, it also pointed out the basic direction of constructing the index system of the rule of law.
The full text of the analysis, we draw the following conclusions: first, construct the index system of the rule of law, to effectively respond to the basic elements of the rule of law, in order to obtain its rationality and acceptability. Secondly, construct the index system of the rule of law, should resolve the concept of avoidance obstacle and public participation in the political supremacy of the lack of lack of these two major problems finally, the rule of law index system requires both theory and practice, can be persuasive and vitality.
